ROFR question

Does anybody who has gone through the process remember or know off hand if Disney dates when they submit the contract back to the reseller? Since the reseller notifies the buyer, one would assume it's the same day. I am just curious if a certain reseller is sitting on contracts that have already cleared ROFR.

I haven't experienced it, but, assuming written notification from DVC goes to the seller via the broker, I'm sure that would bear a date on it. I can't imagine but what it would be in written form - particularly where DVC generally records a waiver in the registry of deeds.

I can't quickly see any advantage for a reseller to sit on notification to buyer/seller in the case of rofr. I would think (if I were the broker) I'd want to preserve the momentum and maximize time to try to move the buyer onto another listing.

When DVD issues a Notice of "Waiver of Right of First Refusal", it inserts a date in the Notice. When we bought a resale deed through the Timeshare Store, our resale agent notified us the same day that DVD signed the waiver.
 
Our reseller forward a copy of the "waiver" from DVC/DVD and it has the date on it, which was the same date we were notified that we passed ROFR.
 

Wow I do not remember getting anything in writting about waiving ROFR last year when we bought I just got notified by TSS and within 2 days had closing docs. This time around they are saying 12 days before we receive closing docs. Busy busy people!
 
I was notified on Sunday that one of the contracts I was selling passed ROFR. I had two communications. One verbal via phone, and another in writing a few hours later. The written communication had Sunday's date.

I'm guessing that some of these large brokers are swamped right now, and are sending out as many as they receive back. They are trying to balance the demand, and I wouldn't be surprised if they get a day or two behind, especially if they try and can't reach the seller/buyer.

I've worked with the top 3 on these boards, and I'll I can say is all 3 were wonderful. They were good to follow up and were timely in their communications. When you're waiting, though, time seems to stand still, but the brokers are flying by the seat of their pants right now! :lmao: Should be a really good first quarter for them. So glad there's been so much activity given the recent economy. :flower3:

jmho here of course, what purpose would it serve for reseller to be sitting on contracts that have passed ROFR ? If they value their reputation and no doubt, most if not all of them do, they would not be delaying. I am sure you picked a reputable reseller to deal with, most likely scenario is increased activity leading up to March 20.

These past couple weeks may have been the busiest resellers & DVC have ever seen. The waiting is tough and anyone who has purchased resale has gone through it; for some relatively quick and for others longer. We became DVC members by purchasing resale couple years ago during what I would call a 'quiet time' and it took around 6 weeks before our points were in the system so the best advice I can give is try not to think about it, unless it is well beyond a month since you've passed ROFR, it just makes things all the more frustrating imagining that something is going wrong somewhere along the way. Have faith, you'll be there soon :)
 
Just an FYI

mjc2003 DID pass ROFR, and is now hard at work planing how to use those points.
