Hi future neighbors.

To those who have lived the same situation with other DVCs.
Many of you said that the laws of Florida prohibit the presale of BVC untill his completion.
Logically, when the building will be finnished, he will be ready to occupy but have no owners.
Do you think that Disney will allow us to reserve in this new location?
If yes it will be a great deal for us don't you?(I hope that the "don't you" is correct, don't forget that it is not my language)

alexx, I can't quote the law but FL law does not prevent presales. You just can't close the deal until things are completed. DVC has generally not sold in this manner but they did with WLV. I think you can expect presales within the next year or so, especially if WLV sells out before BCV is completed.

As for reserving, cash rooms were available at WLV mid Oct but not for points until the official opening date of 15 Jan. If you were buying and couldn't close until the opening date, there would be a delay before you could use your points. Your guide might be able to fix if for you to schedule and then use your points for that first stay.

I believe opening is slated for Fall 2002 but rumors of earlier openings have been frequent. Good luck.
 
We just got back today from VWL, I spoke w/ my guide while we were there and she put our name on a "waiting list" so that she can contact us. She believes they will be preselling BeachClub Villas.
 
Alexx, first your English is fine. We know what you mean. (I'm sure you speak English much better than most of us can speak your native French)

If you (or anyone else) already owned at a DVC resort now, you would be able to use those points to book at BCV effective the first date of opening. (Just like staying in any other non-home resort)

However, if you are not now an owner anywhere else yet, and were purchasing BCV as your home resort, then you would not be able to book until after your new contract actually closed. That would depend on how soon they started sales and how soon you purchased when sales became available. They couldn't actually close until the building opened, but if you bought early, your contract might be one of the first to close, and then you would have points available very soon after the opening.

Also, as Dean mentioned, they might also open it up to cash ressies before it's available for point usage.
 

I obviously open to being corrected by those with more knowledge, but I thought they could not even "presell" without having an occupancy permit for the resort and then they could not actually close on the sales until the declaration of the resort to DVC occurred. This is how the presales at VWL proceeded and I was under the impression that that was about as much flexibility as they had. I guess it depends on your definition of "presell"--I suspect they could take "reservations" or create a waiting list for points, but it would seem to me that P&S agreements and downpayments might have to wait until they had an occupancy permit. Am I all wet on this????
 
Doctor P, it's been a DVC decision, not a FL law. Marriott at Ocean Pointe was taking deposits with signed contracts even before they'd leveled the old buildings and started with the new one. Of course the official closing couldn't take place until they had the units completed, at least the first building. I suspect it was a full year or more before some of those closed. Of course no maints fees until a unit was available for the year in question.

Pre-sales are not prohibited by the laws but the laws do not create much incentive for a business to do them. For any pre-sale, money paid must be held in escrow and buyer has a right to reverse the sale essentially up until the resort is complete and he receives the final approved disclosure documents.
