Resale with expiring points

We made an offer on 200 points at SSR with a YU in March. The seller accepted it today. There are 200 points that need to be used by 3/1/14 and were not banked in time. If it passes ROFR It may just barely close in time but I doubt I will get my member number in time. We already have plans to make a trip the last week in Feb. It is going to kill me to stay in a Ramada because I missed the points by a few days.

Does anyone have any suggestions on what I can do, or should I just consider these points lost?

Does MS ever make exceptions to allow new members bank or use points that are available when the sale closes but were expired by the time the member number was mailed out?
 
As you have the holidays between now and then I think you chances are very slim. I would count them as lost, and also expect availability to be very low with a few days notice and treat it as a bonus if it works. Unlikely Disney will do anything to help.

Exceptions to banking for new members only go to those paying Disney for their points- they are allowed to bank whenever they close- even if it is the day before the points would expire. Since they do not encourage resale they don't help members use those expiring points.
 
The sellers might be still able to bank the current points - even beyond their usual deadline - since MS often allows a one-time-opportunity. If they have already received this unwritten "perk", they won't likely be allowed a second chance.

They should certainly call MS right away before it is submitted for ROFR though.

You could have the sellers book the vacation for you but you wouldn't be able to close until after you went. I would definitely ask though even if I had to sweeten the pot.

I don't know about that I can't imagine me going for it if I was selling. If you delay the closing you delay the sellers getting their money I can't see them doing this

I think this is your best option. As WebmasterDoc said, if the sellers never used their one-time banking exception and don't mind using it to help you out, they might be able to get those points banked for you.

I would do it ... Especially if they sweetened it slightly. Realistically they were not going to close much earlier anyways. Up the deposit to cover the points just to guard against backing out after the vacation. I agree that your Best option is getting the points banked if possible.

I'd ask them to try to bank them then this would be my second choice but in all likelihood they will not be able to do so. They could schedule closing even during the trip itself.

I agree with Doc and Lisa. DVC doesn't know that they are selling. They could easily call and see if the late banking "perk" could be applied and then you would get banked points in the sale. I don't think I would go with the route of sellers making a reservation for you . . . in that timeframe they may decide they want to keep the contract, and then you are out.

See kenspidey's post above for details. The closing would have to wait until after the vacation if they went that route. I am personally not a fan, but it is the most reliable option to assure that the points do not go to waste. Unless, of course, the current owners can get the points banked after the banking window.
 
If OP is already a member, the sellers could transfer the points. If OP is not a member but knows a member, the sellers could transfer to that person who could then make the resie.

I like this option even better. If you know a member see if the seller will transfer the points to them before it gets sent to ROFR. The one thing we are forgetting though is what happens if this doesn't make it through ROFR. I can think of a way around it though.

It's unlikely the sellers would be willing to do such a transfer without some possible compensation if the deal goes south given the cancelation laws. This should generally be done as part of the deal itself with a proportional deposit OR even better, as a separate "rental" paid transfer done before ROFR because that will alter the deal that gets submitted. This could actually aid in ROFR done correctly.

I will ask the broker about this. Thanks for the suggestion. I would think the broker would be aware of this one time perk. I asked him if there was a way to bank the points, he said no since the sellers missed the deadline.

If this falls through you may have one other option.

If your broker is the timeshare store you have one option. Ask if the seller is willing to sell you the points and make a reservation through the timeshare store and reduce the purchase price by all or a portion of the sale.
