Resale Resorts Riv eligibility

I suspect we'll hear nothing, unless those of us who received the ROFR waiver wording between 8/11/20 and 9/30/20 want to start a class action lawsuit ... Not saying we should, but that would probably be the only way to get a response out of them.
So my waiver should fall right in this time line. Where would I find this paperwork? Would it have been filed with the county paperwork?

If it is as it appears to be......... what a screw up on DVC’s part. I could see how it might have happened at this time, but it is still inexcusable. Someone in authority should lose their job over this, but it will probably be the poor sap that had to do someone else’s job they weren’t familiar with because of furloughs that pays the price.

Or, it was a higher up who was doing someone else’s job because all the people who do the actual work were furloughed.

Yeah, the fact that it didn’t get fixed for 6 weeks is troubling for sure.

I personally don't want any money out of a class action. It would amount to $0.50 for each of us, and in turn probably cost DVD - and potentially us via annual dues - much more than that. Only the lawyers win..

But I fall in that range and man would it be nice to get that extra perk of being able to use it at Riviera as well. So I wouldn't mind complaining and asking and generally being a pain in the butt to find out.

Edit:
I just confirmed with my title agent and requested a copy of the waiver. My contract closed in August with the confirmed language:
Effective January 19, 2019, only Members who purchase directly from Disney will be able to use their Vacation Points at the 16 existing Disney Vacation Club Resorts or future Resorts-such as Reflections - A Disney Lakeside Lodge. Resale contracts purchased for the existing 16 Disney Vacation Club Resorts will only be able to exchange Points into those 16 Disney Vacation Club Resorts.

Of course these restrictions were hurting new sales. It kept us from buying more, and they know it.

Problem is comments like this are written from the perspective of an educated timeshare owner. And only a tiny percent of people who buy from the developer are educated consumers.

The restriction is an obvious turn-off to those who understand timeshares. But to Average Joe who sits thru a DVC sales pitch, it's one more arrow in the quiver of a salesperson. If the topic of resale is even brought up, it gives them the ability to say that the only way to have full access to the entire roster of resorts is to buy direct. And that is absolutely true.

The resale restrictions don't exist as some irrational "gotcha". It's a calculated move to drive sales up. Until the day comes when DVC does reverse the restrictions, we have to assume that they believe the restrictions have helped close more sales than they've hindered.

I got a survey from DVC today asking about my recent direct purchase, and some of the questions in there specifically asked me about what I thought of the Riviera Resale Restrictions (and one asked me if one of the reasons I bought CCV over Riviera was due to those restrictions). Perhaps Disney IS reconsidering it.

I think this survey may go out to anyone who had a purchase, whether direct or resale, since the survey did ask if I had purchased direct or via resale at the beginning. Alas, there wasn't a way for me to answer BOTH. ;-)

I passed ROFR on 9/22/20 on a BLT resale. After reading this thread, I emailed my broker for a copy of the paperwork. This is what it says: "Effective January 19, 2019, only Members who purchase directly from Disney will be able to use their Vacation Points at the 16 existing Disney Vacation Club Resorts or future Resorts-such as Reflections - A Disney Lakeside Lodge. That is one that existed before yesterday and was provided when your waiver was given. That is what has now been corrected starting with ROFR waivers given October 1. The ability to reserve based on post-mid-Jan 2019 resale contracts is back to being stated in the waivers as limited to the 14 pre-Riviera resorts. In other words, someone with DVD screwed up with the waivers that were being issued for a little more than a month. Also, the resale restrictions that appear in the POS documents for Riviera, which prohibit post-mid-Jan-2019 resale purchasers from other resorts from reserving Riviera and prohibit Riviera resale purchasers from reserving any resort other than Riviera have throughout remained the same as they were before. It would have been nice if DVD had actually done away with the resale restrictions, but unfortunately not now.

Thank you!

That has been reported on Direct purchase surveys since shortly after Riviera went on sale.

I hope more people who get this survey fill it out and express their displeasure with the restrictions.

Let me know if you complain and it works out =) I might have to do the same then, lol.

So resale purchasers with the "16" in their contracts will or won't be able to use them at Riviera?
