Red Light Camera Ticket

You should have received a notice of violation. That was the time to fight it. It's actually fairly easy to fight it but it won't be worth it if you have to go to court and you are not a resident. If you fight it, request the maintenance records of the camera system and the certifications of the maintenance personnel. You can also request the time sequences on the light and if they don't adhear to the national standards, you contect that. Also what is considered running a red light? is it entering the intersection on yellow and still in the intersection when it turns red? How far into the intersection do you need to be before it's considered a violation? The camera is aggressive, thats because the camera owner gets most of the ticket money. You make it difficult for them legally, they will drop it. But you have to act right away. If it's gone to collections, pay it.

These are no points violations because it's not a person issuing the ticket.

In my town, it's a $25 fine. My time is a lot more valuable than that; I wouldn't waste time doing the above. Faster to just pay.
 
Ours was about $120 in Fife, WA. My brother is in San Diego and he reports that a red light ticket here is over $400.

That is correct ($480.00 ish) ... Although they were discontinued
in the San Diego City Limits. The new Mayor said no more
"Welcome to San Diego here is a $500.00 Fine".

They are still in various other Cities within San Diego County.
 
Here in NY they send you a picture of your car with the license plate visible so you see if you did go through the light.
 
In the Commonwealth of Pennsylvania it is the law that the court must cite the driver of the vehicle not the registered owner. A non moving violation, the owner may be cited such as a parking ticket, lack of current registration. A ticket showing just the car would not be sufficient proof in the State if a red-light ticket was issued. It would have to have a picture of the driver as well. If a driver presents any prove that they were not the driver the ticket is dismissed. That is part of the reason that red-light cameras are only legal in Pittsburgh, Philadelphia , and municipalities w/ a population >20,000 and police departments accredited by the Penn. Chiefs of Police Assoc. in Bucks, Chester, Delaware, and Montgomery Counties. Florida probably has similar laws when it come to proving the driver. Personally I am against any method that tickets the registered owner over the driver, and with the low dollar amount of the fines it doesn't pay to challenge the fines to higher courts to challenge the constitutionality of the tickets. Loaning a car to a person does not assume responsibilities for any laws they may break with said vehicle. If I loaned my neighbor my chainsaw and they killed someone with it should I be charged with murder?

The light that prompted the question is either the first or one of the first lights you encounter when leaving the airport. So that "welcome to sd" quote was accurate! :). And yes my brother said that they disabled at least that one. I didn't get the impression that all were disabled in sd, but despite what he thinks he isn't actually omniscient.

In WA they sent a link to a site that showed video taken from behind the car. Could see our car, the backs of our heads, and the light fully changing before we entered the intersection. Crazy. We were paying close attention that day and I would have sworn we stopped before turning right, but....
 
I think several states have struck them down, but I'm sure they're legal in several states.

I think you are entitled to a video or photo of your going thru the light. If they can provide that, yes, I think you better pay. If you have not seen the evidence, I believe you are entitled access to it.
 
Interesting because I just got one of these last week.

It was in Corpus Christi, TX - came with a link to online video that shows my car turning right on red without coming to a complete stop first.

It is a civil violation, fine = $75. If I don't pay it goes to collections.

The notice came with three options:

1. Pay the $75
2. Provide a notarized affidavit that somebody else was driving and who that somebody was
3. Travel back to their nice little city for an administrative hearing.

I sent the notice back with the second option, along with a statement that "Unknown" was driving because I was in Port Aransas that day with a rented golf cart while several friends and family members had access to my vehicle and took advantage of that access to run errands, etc. so if they can provide me with a clear image of the driver I would be happy to try and identify them.

I also indicated that I could not afford the services of a notary at this time so if they could refer me to a free notary or reimburse me for the expense that would be great.

I'm waiting to see what happens - in Texas this has gotten quite the reputation as a money grab so even the slightest pushback tends to have the "fine" waived.
 
We have used free notaries at banks. One at Bank of America when MIL banked there, and one at Wells Fargo when we didn't bank there. (DVC loan had "mortgage" on the paperwork and our bank Washington Mutual was on its way out and refused to touch the paperwork) Was very easy to walk in and ask for a notary.
