If a CD is out of print, and cant belegaly obtained on CD, is it legal to download it off the internet?

if you can find it in Itunes I would think so or some other program where you would pay for it!

plus with the internet and ebay you should be able to find a copy?!??

Well, the CD, Ol' Brown Ears is back, was a limeted release, sells for 100 dollars used on amazon, and is from the ninties.

Its not on Itunes, or any other service like that.

I did some research, and it seems as though it would be perfectly legal.

It wouldn't be legal. The copyright on the recording would have to have expired thus putting the recording into the public domain for you to copy it. The copyright runs for the life of the copyright holder plus 70 years.
