Question about transferring points

Hello,

I'm a new owner and still trying to figure out how everything works. My contract was stripped and I don't have enough points to do everything I want to do this year, even after borrowing from next year.

If I were to request a point transfer on the rent/trade board, how likely is it that someone will be able to grant my request? Have many of you done transfers before? Are they easy to do? Are these requests usually granted or not?

Anyone's opinion with point transfer experience would be appreciated.

Most owners don't want to waste their time or one transfer per year. There are always exceptions, especially now with the poor economy.

Remember transfers retain their home resort priority and UY.

Since we only get one transfer per year, the greater number of points needed may make it more appealing to the transferring owner.

I am in the same situation as you - I bought a stripped contract and won't have enough points for my vacations in 2010. Also, I bought a very small contract so I will be needing a couple more transfers over the next 2 years until I am able to buy another contract. In my situation, I am also looking for a small number of points to have transferred initially and I am actually working with another member right now for my first transfer. I recommend looking at the postings that have only a few points to transfer to begin with. There are quite a few actually and new ones are always coming on. You should also be willing to take a few more than you need, that way you will be the preferred buyer. You can always bank the extra points that you won't be needing. Good luck!

Well, you are the owner renting them out, so I believe you call the shots. You can request payment in full before the transfer. I think many do request a contract in writing, too. Good luck.

Once the points are transfered, you can't get them back if the other party doesn't pay. Use caution.

For the recent transfer "in" of points that I just did, I required the points owner to transfer the points to me first. This was my thinking - the points owner had a pretty low post count (I know mine isn't the highest but theirs was a "newbie" figure). It was also a low amount of points - I have seen other posts regarding the buyer sending half the money, then the seller transfers all points, then the buyer sends the rest of the money. This would have been acceptable for me if it were for a large number of points but since it wasn't I didn't see the point. Lastly, for me, I see it as easier for the point owner to get a remedy than someone sending someone cash (since there is no way to be certain they even own DVC). I'm sure others will feel differently. I just think that if I owned points and transferred them to someone who didn't pay, I would immediately call the police. Since you have the person's DVC # the police would be able to track that individual down. The seller and I had a written agreement that I would pay $$ for a transfer. I provided the seller with my contact information and my phone number. It worked smoothly for me. Again, I know it's different for others, this is just how it worked for me.

The police would tell you that it's a civil matter and/or out of their jurisdiction. You could sue in small claims court, but you don't know who to sue. DVC won't give you the personal information on the other member without a court order, if you can find a court that will issue one. If you do get the other members information, you have to pay a Sheriff, Marshall, or Constable to serve the member with the law suit. Should you win a judgment, the courts will tell you that it's not their job to collect the judgment, it's yours.

If you read the Public Offering Statement closely, technically, members are not supposed to receive any compensation for transferred points. So if the member you transfer to doesn't pay up, DVC won't be there to help you either.

DVC states that point transfers may not be made for compensation. So if you transferred points and someone didn't pay you, DVC would do nothing since according to their policy transferring points for compensation is not allowed.

Now points are sold and transferred all the time. The DVC statement legally protects them in the case of any dispute about payments.

It would be strictly a civil matter where you would have to sue in a civil court with no assistance from DVC.
