Question about "annual dues on points for the year 2002 allocation?

Finally found our resales. The right combination of resorts, points and use years. We will have 150 points at BWV and 200 at VWL. Including closing costs and all, for 350 points these resales will save us about $3,000 over a direct DVC purchase. Thanks so much for your help :)!

One more question before I fax the contracts. I want to make sure I understand how the annual dues relate to allocated points. I am working with The Timeshare Store so I assume the contract language is pretty standard.

The contrcat states that "Buyer is responsible for the annual dues on XXX points for the year 2002 allocation".

It was my understanding after speaking with Jerry (Sydow) at The Timeshare Store that we would start paying dues with the bill that comes out this January and that we would not be reimbursing the seller for any dues paid prior to this bill. Our use years will be August (VWL) and Dec (BWV).

Does this contract language agree with my understanding? What point allocation will the dues this January relate to? Were there any dues associated with the 2002 allocation that were paid in last year's bill? I just want to make sure I don't get surprised with any dues I didn't plan on.

Dues go by calendar year, Jan to Dec, regardless of your use year, and thus contract language looks right in relation to what you were told.
 
To further illuminate what drusba said, we just got our invoice for the 2002 dues for our August use year contract. They are payable by January 15 and are for the points we will be using August, 2002 through July, 2003.

So yes, you should probably be responsible for the dues on the points you will be getting in August and December. So I agree with drusba that the contract language looks right.

The dues payment coming up will be for 7 months of the WLV 2001 points and 11 months of the BWV 2001 points. So if the 2001 points are gone, you're overpaying by as much as $1000 if all of the 2002 points are intact and there are NO 2001 points left. If at least 70% of the points are there from the 2001 use year collection, or there are additional banked points that you personally would use, you are likely ok.

Unfortunately the basic timeshare addage of you get the week, therefore you pay the dues, isn't right for DVC. Anyone that tries to tell you that you get that years points and therefore should pay the whole years worth of fees according, is either misinformed or dishonest when it comes to DVC.
 

Dean - both these resales have all the 2001 points available and some of the 2000 points banked so they are pretty good deals.

I guess the way I view it now is that the dues bill that comes out this January is for the 2002 points allocation - which is available for use from Aug 2002 to July 2003 (WL) and Dec 2002 to Nov 2003 (BW).

The dues paid in Jan 01 were for the 2001 point allocation which was available for use in 2001/2002.

If that is how it is structured and should be viewed I have no problem paying this January's bill. I guess there are a number of ways that one could read the contract language. However, from what the resale agents are telling me it would be normal in this circumstance for the buyer to pick up this January's dues bill. Do you think a fair argument could be made for not paying this January's bill? I don't want to upset the apple cart. We are getting the VWL points at $63 a point and BWV points at $60.

One agent on another resale was saying I'd have to pay this January's bill and reimburse the seller for what they paid last January. We walked away from that one (thanks to your advice and other's and the fact that we found a better deal :) ).
 
As the contracts have all the 2001 points, paying the 2002 dues and nothing before is a good deal. As to which year's points the dues apply, you really need to divide the two concepts. For any contract, dues are for an annual period, Jan to Dec. and are per point in the contract regardless of the usage of those points or in what month they were issued. Thus, everybody, regardless of their use year, is charged a set sum per point in dues in Jan of each yer for the calendar year that begins with that Jan. If you have a 150 point contract, you pay dues on the basis of having a 150 point contract. Thus, the dues are not associated to either 2001 or 2002 points. They are just what you owe on the whole contract come every Jan.
 
The dues bill is for the calendar year - so for BWV you would be paying for 11/12 of the 2001 use year points (138) and 1/12 of the 2002 use year points (12), and for VWL you would be paying for 7/12 of the 2001 use year points (117) and 5/12 of the 2002 use year points (83).

You can view it any way you want but that is exactly what I was saying was NOT correct. The Jan dues are NOT for the 2002 points, they are for the time of January to December which is mostly the 2001 points in your case. In this situation it does not matter as you are getting all of the points for which you are paying even if you are thinking about it the wrong way. Good luck and enjoy.
