Photo contest rule breakers?

I have summited a picture I personally took per the rules but when I look at the pictures to vote on I see ride pictures and photopass pictures. These are not taken by these people but taken by Disney (which we were told no pictures taken by Disney allowed). If these had been allowed I would have selected a better photopass picture to submit. Sorry to sound whiney but disappointed I couldn't submit my best photo. :confused3
 
This was written in the rules fine print as well: "In the event a photo with the most votes is deemed to be invalid based on these rules, the photo with the next highest number of votes will be chosen."
 
I know the rule is one photo per person. Does this include both Disneyland AND Walt Disney World? In other words, I submitted a WDW photo already. Can I also submit a DL one? Don't want to break the rules!
 
Looking at the rules page right now and I can't see where you get the idea they needed to be taken personally.

All images submitted must be the work of the individual submitting them and must not have been published elsewhere or have won a prize in any other photographic competition. Entrants must warrant that the photograph they are submitting is their own work and that they own the copyright for it.

As to photopass photos, they would not be the work of the individual submitting the photo nor would the entrant "own" the copyright.

There is also a question about photos submitted by people who are in the photo. To "own the copyright" the person would (1) have to have set the camera on a tripod and use a remote to trigger the shutter or (2) have input all the settings on a camera, composed the photo, and handed it to another person to press the shutter. The photo would then be a joint work - each person would hold the copyright. If you hand me your cell phone and shoot camera and ask me to take your photo with it in front of the Castle, I own the copyright in the photo. There is, of course, an implied license to use the photo and it would be all but impossible for me to actually prove that I was the person who owns the copyright.

Just to be clear, these are my opinions. I don't speak for DU or the DIS.

Looks like disney still owns the copyright, but gives a limited license to reproduce for personal use. Pete did say you can use photo pass photos. Look for the question posted on 5/15 to the disunplugged Facebook page.

As I said, what Pete does is perfectly fine with me. His site, his contest, his rules.

The photo pass website states: "All photographs taken by Disney's PhotoPass Photographers are owned and copyright protected by Disney."

With photo pass, you typically get a license or "release" from Disney to print the photos commercially but you do not own the copyright. Of course, there is very little risk that Disney will bring an infringement lawsuit simply because few if any photo pass photos have any commercial value.
