OT - I can't believe that PayPal allows this !!

If you check out the link to my auction in post #30, you will see that the amount of ram is listed in 2 places on my auction: in "Item Specfics" and in auction description itself - in fact, it's the first spec I mentioned !! I guess that not mentioning it in the auctions title in bold red letters is my fault huh ? =)

I really appreciate all the advice from you folks with eBay and PayPal experience. I guess I will end up refunding the guys money; at least I still have the brand new sealed laptop. However, and I know this is spiteful, and I'm getting into my flameproof suit right now, but please tell me how I can make the seller wait as long as possible to get his refund.
 
DIS a good place for ebay sellers to post. Most posters agree with the seller. You make a great point. You should at least start with the premise the customer is right. Ebay, not the seller, makes the decisions. OP thinks she has leverage because she has the money. That can easily be reversed.

Right now the OP doesn't really have any damages. Ebay should be willing to reverse any fees. The laptop hasn't been shipped. Nothing good will come from shipping the laptop.

The laptop was a BB Black Friday Special. It was sold with less RAM (2G) rather then the 4G which is typically included with this model. The OPs listing "heading" didn't mention how much RAM was included. Almost all the other listings for this laptop mentions the amount of RAM in the item "heading". Yes the amount of memory is listed in the "fine print". Interesting the only real important piece of information about that laptop was omitted. Was that omission a mistake or was the seller being intentionally deceptive? The OP has sold almost 1000 items. I'm sure she noticed the fact that the amount of RAM should be included in the "header". She got caught. Move on.

The OP asked what to do. I don't think any poster agrees with shipping the laptop.

edited to add--The last couple of years BB ordered special laptop configuration for black friday. A year ago the laptop was listed as stereo but it only had one speaker. It was stereo if you used headphones or external speakers. Deleting one, very cheap, speaker from the case is one of the things that was done to meet a price point. The OP waited in the cold to buy the laptop. I thinks she's frustrated the computer isn't worth what she thought it was.

I'm a guy btw. I had 20 bidders for the laptop above $250; in fact I did do the 2nd chance thing via eBay but the guy that already purchased a laptop by the time I made the offer.

I'm not at all frustrated regarding the laptops worth; I'm frustrated with the antics that the buyers are now apparently allowed to get away with !! I will say again .. eBay needs to tighten up this loophole and ban sellers for 3 months that purchase items over $200 and then decide they dont want to complete the sale.

My opinion is not to send the laptop, because most probably the buyer will get his money back.

I haven't read the whole post, but I know cases (my own) where Paypal gave the buyer the money back, altough I've sent the product.

Yep. Cut your losses. Shipping an item a customer doesn't want and has said they will reverse the payment for is just asking for a huge time consuming ball of trouble.

FWIW, I was a ebay seller for years and I now sell on another venue with over 4000 + feedback. I've learned that even if you're "right" as a seller, its bad for your business to spend hours of time arguing and fighting. At this point you have your item, you can easily get your fees back and you can walk away.... or rather walk over and do a "Second Chance Offer" while those bidders still might be interested.

Having the Pay Pal tell the buyer one thing and you going to Ebay to have them tell you another thing is just going to turn into a rats nest of confusion (and I don't think you can open an Ebay claim, once a claim has been opened in Pay Pal for the same transaction. I think it actually asks you if this is the case when you attempt to open a dispute)

Longer you make the buyer wait, the more likely you will get a negative. Plus if he starts a chargeback with his credit card company (which he would likely win) PayPal will stick you with a $20 chargeback fee.

Refund now and move on.

Are you SERIOUS!? You already said you sold it to someone else, now you want to be spiteful and keep the guys money as long as you can?! A week before Christmas? That is just MEAN. If I were the buyer, you'd have a big ol red negative!

You must of misunderstood, I never said that I sold it to someone else. I have it still, packed and ready to ship in my office.

And what's MEAN in my book is buying something and then screwing over the seller.

FYI, eBay has assured me that even if the guy did give me a negative, it would be reversed. Keep in mind he has used the eBay message system [that eBay and PayPal can read at anytime] to tell me that he will not accept the item. There's no way he can leave me negative feedback that would last.

And yes, it is still mean to not give the money back immediately. Two rights do NOT make a wrong. And he would be 100% within his rights to neg you for no refund and no item!

I did in fact do a 2nd chance offer, to the guy who had bid $1.00 below the winning bid. He actually called me and told me that he had just purchased a laptop 4 hours earlier at BestBuy. The laptop is still in my possession.

I wish I could print out all of the buyers notes that he's sent me the eBay message system; you might feel differently about me being such a meanie.

If the guy had written me and said he had made a mistake and asked me to refund his money I probably would of done so. But no, he was in full attack mode from the get go, accusing me of selling "outdated equipment" and indicating that my auction listing was "just plain inaccurate." He told me he was going to contact Visa and dispute the purchase within 18 hours of paying me. He's apparently not aware that while he may of used a Visa card to pay, the payment was processed by PayPal. I should also mention that the buyer purchased another laptop similar to mine, but with more ram, within 24 hours of paying for mine. It would seem to me that evidence, in of itself, indicates a clear case of buyers remorse - which is not my fault.

I think it is rude and disappointing but I don't think you've been screwed over. You have the item, and they cancelled it in a very timely manner. I really don't think it is worth fighting as you'll have to hold onto the item (when it could be relisted or offered to others as a second chance), and you'll spend hours on the phone with Ebay/PP.

I do think you're making it worse than it has to be.

I understand the disappointment of a cancelled sale (I depend on on-line sales to pay bills), but it seems like you're going to waste a ton of time and energy fighting this, when you can just walk away and get on with a bunch of other sales.

Okay - you are going beyond mean and being rude by posting their user name! That is against DIS policies and that is just NOT nice at ALL! SO WHAT if they purchased another laptop - at least it had the more RAM that they were concerned about! Sheesh. Just give them back their money, block them, and be done with it. Stewing over it is just making you more angry and is so unnecessary - you HAVE to give the money back anyway so why not do it and be done with it.

And you really should edit your last post to remove their user name - that is uncalled for.
 
I want to thank everyone for listening to me vent; it's actually been helpful.

I was just hoping that someone would say yeah Phil, you were screwed over and that sucks. =)

Y'all are right; life's too short to get my blood pressure elevated over a stupid laptop.

I plan to refund the money to the guy tonight after I get home. I will wait until after the holiday season, and try and resell it.

You already have. You can either ship the item, which posters in this thread think is a horrible idea, or you can issue a refund. Don't ship and don't promptly issue a refund. Won't be good.

I agree the buyer should have read the complete description. I can also so how a buyer could have made an honest mistake. The laptop normally comes with 4GB of RAM.

I can't think of a single honest reason why you didn't include the amount of RAM in the title. Yes, by not listing the amount of RAM in the auction title you contributed to the mistake. Yes that was your fault.

You can say the buyer made a mistake and you contributed to the mistake and move on. You can continue to think the buyer is trying to screw you but thinking that won't help.

You haven't shipped the item. You need to move on. Maybe the next buyer won't overpay and you'll get $25 less.

The buyer wants an opportunity to correct an honest mistake. Screwed over would be if he wanted until he got the laptop then started playing games with you. Let you ship and refuse delivery. You weren't really screwed. You were aggravated but not out any money. You still have a NIB laptop to sell.

So much has changed with Ebay I quit selling.

Exactly. When they changed the rules to make it unfair to sellers, I stopped selling, too.

It isn't fair that the OP listed her item exactly as it is, the person bid and won fair and square, and now the OP is out the listing fees, etc.

Oh, gosh - if it were me, at this point I'd just give him back the money and tell him "sorry, I've made a second chance offer to another ebayer since you said you didn't want it" - you don't need to disclose that the other ebayer didn't buy it.

But if you DO send it, definitely send INSURED and Signature REQUIRED - I would send UPS or Fed Ex because USPS accepts a scribbled/wavy line as a signature and doesn't collect names (I know from bad experience).
