OT help-my ex has kept my kids

We leave on friday for Disney, on tuesday we have tickets to Wicked. My ex (we have no legal docs yet) had the kids for christmas-I was suppose to pick them up tonight at 6. Now he has emailed me saying that I can;t get them. He won't let me talk to them on the phone. The Wicked tickets were the kids Birthday present. I've called the women's shelter- they recomended that when I get them back not to let him have them back again. I left a message with the police but I don't think they will do much. my lawyer is of course on holidays- Any help out there
 
Oh goodness...no advice at all, just wishing you LUCK and lots of it! Surely-he knows his children and looking forward to all these activities and wouldn't deprive them of them? Not much of a Dad if he would..:sad2:

Hope the Police being involved can help smarten him up!
 

You must be frigging FRANTIC. What a craphead. Have you heard anything from him yet???

If you are in Ontario definitely go to the nearest courthouse tomorrow morning and get the duty counsel (free counsel) to file an emergency custody motion for you. It will be heard by the judge the same day it is filed. Unfortunately, without a court order the police can't remove the children from your ex, unless of course you believe they are in danger. Its so stupid that without that piece of paper you both have equal rights no matter who has been the primary caregiver.
 
Thanks LeeAnn I didn;t know that. I called the womans' shelter and the police and neither told me this was an option. I'll be there first thing in the morning
 
Wow!!! I agree with Leanne's advice. Best and quickest way to tackle this.

Call CAS, they are pretty good with advice. I have to call them all the time, I work with kids. S

Good luck tomorrow! I always worried about this with my ex and the kids. Luckily nothing like this every happened, and I'm so thankful they're older now and have a voice of their own when it comes to dealing with him!

:goodvibes please ...still consider going tomorrow morning to file for that paperwork so he can't pull that again. nothing to stop him from the good guy one minute bad guy the next pattern. and if HE finds out he can go to court and get an order he may do just that?!?! sorry to be negative, unfortunately have been through worse.

Edited to Add: My attorney would say to print a copy of his email and take a police officer with you, considering his email as written consent even if you don't get a court order. I would be so hesitant after what he's pulled today, you have no guarantees that there will be no drama but it's better if you have your bases covered. Sorry .... it breaks my heart to know what you've been going through in the past hours.
 
How scary for you and your children! definately file a custody motion asap! I will pray for their safe return to you tomorrow evening without incedence
 
Do you have something in writing from him giving his consent for you to take them out of the country on Friday? Make sure you have that so he can't charge you with kidnapping!
 
You need something in writing giving you custody. I would be concerned that he got an emergency motion for custody. I would not leave the country with the kids unless you have custody in writing either by agreement or a court order. If you don't have anything he might charge you with kidnapping and this would take the custody matter in an entirely different direction.

Hope it works out but the police won't help you without legal custody. I can tell you that they will help you once you have the legal papers. My ex once called and said he wasn't returning DS. I called the police and he got a visit and DS was returned promptly. I was concerned because he was out of the province (still in Canada though). The police advised that his plane was delayed which he had neglected to tell me. I must say that he never pulled that "joke" (as he put it) again. Before the police could help though legal custody had to be in place.
 
Also, I don't know how old your children are, but would it be reasonable for you to get them a cellphone? One that they would keep with their stuff, so that they can call you or you can call them if needed. Missing a play is one thing, but I would find it hard to trust someone who had pulled a stunt like this.
