Hello,

We paid our DVC mortgage or financing off back in March. We have not received anything from Disney showing a canceled documents or deeds. Does anyone have a link to the Orange County records that we can do a search on our name ?

I have seen it before, however, I cant find it.

Is there any way I'll be able to tell from this site if an offer has passed ROFR and maybe our agent just hasn't called us yet, if I have the contract# and parties names?
 
The site does list ROFR information, but it's updating lags the actual event by quite a bit. You can try looking for your sellers name but the ROFR probably won't be there yet.

I know this is a tough wait, but hang in there. Things will probably work out just the eay you want. :pixiedust:

ROFR is recorded with the deed. You can check what they own and make sure no one else is on the deed. You'll know the ROFR and other info before it's recorded with OC.

I've worked in the mortgage industry for 25 years and cringed a bit when I read your original post. You seem a bit confused about the process that goes on with paying off your mortgage so here is the scoop.

First of all, you mention "...cancelled documents or deeds". FYI, the "Deed" is the legal instrument recorded with the county that shows YOU own the property. This was 'recorded' when you bought your property and will NEVER be cancelled.

Typically when you payoff a mortgage, at some point the lender, (Disney) should return the original mortgage and the original promissory note to you; both marked "Paid in Full". I don't know what Disney's practice is in this area; perhaps others that are more knowledgeable or have had personal experience will chime in. A call to MS would clear up which way this is handled.

To remove the mortgage of record with the county, the lender must also issue a "Satisfaction" of the original mortgage. This is a legal instrument that needs to be 'recorded' with the county. Since the lender is out of the picture at that point (they've gotten all their money) and since 'recording' this document with the county costs money; some lenders will mail the original "Satisfaction" to the owner of the property - making it their responsibility and expense to get it 'recorded'. IF they do make this your responsibility make SURE you get this instrument recorded. Again, see if others who've been through the process know which way Disney does this. As before, a call to MS would probably clear this up too.

Congrats on paying off your mortgage. I hope everything was 'recoded' and its all done. Now...just enjoy all those vacations for the next 30+ years!

I was able to find the seller and the particular contract. It seems to be just the way it was presented to us., so that's a refief.

I remember reading a tip somewhere about checking to be sure they really own , but I think that was if you weren't using an agent.

I hope you're right. What happens if the offer states closing must be 60 days from this date and they still don't call? That's 14 days from now.

Disney files a Satisfaction of Mortgage with the county when the mortgage is paid off. Do a search for your name as the "Grantee" and you should find a Satisfaction document in the results list.
 
JAX,thank you for the link. I checked our name and I found the deed and the mortgage. The mortgage has not been canceled. We paid off our mortgage in March, 2008. I am surprised that this has not shown up.

I called Member Services and they acknowledge that the mortgage is indeed paid off. When I told them that the mortgage has not been satisfied on the Orange County website. She did not know what to say or do. They are supposed to have someone call me back regarding this.

I have to think they could have recorded this within the last 6 months. I will update this when Member Services calls me back.

PS-Boardwalk Prof.....Sorry to make you cringe. I knew they needed to cancel the mortgage and file it with the county and that is what I meant by documents. I should have been more clear. Without the canceled mortgage filed this means that Disney is still showing my deed as being encumbered and thus I do not have a clear title even though I paid off my mortgage. Not Good in my opinion.

Technically if you have not closed by the specified date, there is no built in extension and it has not been formally extended; you don't have a contract and either party could legitimately back out without penalty.

WHAAAAT! No way!

Is there anything I can do to prevent that? I really really want this one. On 10OCT Disney notified my agent that the contract was short 40 points for this year and had us fsign & fax an acknowledgment. When I called her last week she said she still had no word back.

Is there no one at Disney I can call ?

Discuss this with your broker to see where everything is and where you stand. As I said, the above is the technical answer but many contracts close outside the parameters of the specified closing date.
