I think this is a very hard topic to answer because most of us did not know the details of the sidewalk proximities, I don't think anyone was flaming you or your sister. The original post was a very general "is it wrong to park on the sidewalk" question. In most cases it would be hard for the pedestrians to walk safely if a car was on the sidewalk, but since your town is different I guess the opinion of people not from Lakeland will not be able to give an answer that suits you.
Also not flaming, just another opinion :)
 
Honestly, if the sidewalk is their property legally why should they care if it's considerate to the pedestrians to park on it or not?
 
Michelle.... i agree.... this post was very general.... no one was flaming me... i was just taking up for my sister...

this is now a NON issue... thanks for your opinion.... i appreciate them all...

LOL.... this has been fun to be honest.... i wasn't upset or mad, it was fun just to see how far it would go...

Kiddo, sorry I was actually saying that to the people who were complaining that as pedestrians it would be inconsiderate to them to park on the sidewalk (and I'm a frequent pedestrian.)

well i guess i just have met the ones that need to have a night stick taken to them... LOL....(you will have to excuse my sense of humor... it is rather sarcastic...)

i love our neighborhood.... and when i moved out of my parents home i never went too far.... in fact i live about a block from my parents and Julie_Yet....
 
I'm not sure where the property lines are in your situation. In our neighborhood you have to get "approval" from a committee to do anything to your house/yard. Before you paint, add a fence etc. That is not what this is about, just a idea of the neighborhood rules. Well, our neighbor across the street got a ticket on his popup camper that he had parked on the grass in front of his house(temporary). I guess it was city land, or perhaps because he broke the rules ?? Anyway, he moved that camper and hid it away.

Perhaps because it likely is <b>not</b> their property. In most towns, an amount of land from the road anywhere from 5-10 feet belongs officially to the city to be used for sidewalks, pipework, underground cables, whatever. The city may plan in the future to go ahead an put in sidewalks. Actually, in our town, the city owns 8 feet of your land and it is the homeowners responsibility to maintain the sidewalk and put in a new one if the city wants it.

So, if the cops want you to move your car off "their" sidewalk they have a right to do so even if you think it is not necesary.
 
Kristy, that's why I said "if" it is their property. If it turns out that it isn't then I would have to side with the policeman on this one.

i think this is the most unbelievably rude post i have ever read.... and this is now a non issue..... oh by the way Kristy.... the cop was being a jerk.... plain and simple....

he was rude to my mother and to my sister... this was just a cop with an attitude... throwing his weight around....

i have already said that this is a done deal but people keep dragging this thing up from the DEAD....

it started out as a "harmless" question from a woman who meant NO harm and at every turn has been FLAMED unnecessarlily....
 
How on earth did you read that as rude? Is it because i didn't add the "no flames intended"? Good grief!

If you and your sister think that responses that simply disagree with her constitute flaming, perhaps you would both be more comfortable posting at the Mary Kate and Ashley Oleson site.

I think your sister's question was a valid one, and I think that a number of posters here have tried to offer opinions after your sister ASKED for them.

So, can you or can't you? It is an interesting situation that I'd never really thought of before and I'd be curious as to the answer. People on our street without a sidewalk always park all the way down to the bottom of their driveway.
 
Typically there are 5 foot to 10 foot set back lines that surround a property.

Usually there is a 10 foot set back line from the street including any walkway area that would have been put in by the owner. Even though the owner constructed said "side walk" it is not theirs. It becomes the City/County's by default per most City/County ordinances, IF it falls within the set back area. This allows the City/County to do any maintenance work necessary.

City/County Police and Sheriff typically know the public ordiances such as these because they are routine violations.

I hope this helps. FYI I am a Commercial Real Estate Paralegal and review such ordiances and surveys for Commercial property as well as Residential on a daily basis. So I guess you could call my opinion (not a flame) an expert one.:p
 
I'd rip the "sidewalk" or "piece of a sidewalk" (considering it's the only piece on the street.... anyway- if the previous owner put it in... I'd rip it up and park where I wanted to.:teeth: BTW... It doesn't sound like a sidewalk to me, it sounds like a "walkway" to the house.
