First post here. I rarely post to boards - usually more of a lurker - but I need to vent. We have been visiting WDW with our 4 young children annually for the past few years, and expect to continue to do so for quite some time. We met with a DVC rep at SSR last Oct, and have have been considering DVC since. After we "discovered" DVC, we also found out that 2 other families we know are DVC members.

We seriously considered SSR particularly with the incentive offer. We decided instead to purchase a re-sale because we felt BCV would better suit us, and we found a contract for sale with the right number of points. We offered just below asking price and splitting the closing costs. Seller agreed to the price, but wouldn't agree to splitting the costs, so we eventually agreed to pay all costs. After we signed the contracts and sent them in, the Seller reconsidered, and wouldn't agree to sign the contract unless we paid their original asking price and all costs. After careful consideration, we agreed, and signed new contracts.

Now, I find out today that the Seller won't sign the new contract either, and no longer wants to sell. While I appreciate that they must like DVC, we are very disappointed. Not only did this not work out, but now the incentives for buying direct from Disney have expired.

I guess this one just wasn't meant to be, and it's back to the beginning.

Sorry for the rant, but I needed to vent. Hopefully I'll be able to reply again (soon) with better news.
 
I'm not any sort of resale, or legal expert.
That said, some on these boards are, and hopefully will be along to help.

Did you use a resaler such as The Timesahare Store? If so, I would bet they still charged the seller the 10% commission. Afterall, they found a buyer at their price.
So, even if you got hosed, it should feel a little good knowing they got hosed also. :teeth:

:welcome: I'm sorry your experience has not been a good one. I thought I read very recently that there are some incentives right now. You might want to give it a second thought to go directly through Disney. Good Luck, let us know what you decide to do.

So sorry for your problems, I am surprised that they had backed out after getting what they want, i would be pretty irritated too :mad: . Maybe they will see this on the boards and realize what they are doing to people!

This is probably one of the prime examples of resale vs direct arguments....when all doesn't go well. But don't be disheartened and if you really want BCV find another resale and try again!
 

My first attempt at a resale contract was about the same, except a week or so later TSS called and said the seller decided to accept our offer after all. Hopefully you'll be a member soon.
 
I had a similar experience with my first attempt at resale. There were no negotiations -- we agreed to pay the listing price, sent a deposit and contract, and thought everything was fine. The seller - in Argentina - agreed and we waited for their signed documents to come back so the deal could be sent to Disney for ROFR. Never came. Finally, the TTS agent (who was wonderful) tracked the girlfriend down, and she said the owner wanted a higher price than they listed for. We declined and withdrew our offer.

Technically, I think TTS could have demanded at least the payment of their commission, but as far as I know, they didn't. They did refuse to relist the contract at any price because the owner had not listed in good faith.

Things sometimes happen for a reason, and we bought another contract through TTS a few days later -- for a lower price, with banked points, and with no worries from the seller. Very nice, smooth, stress-free deal.

If you're dealing with a reputable broker, I wouldn't worry about it. Just look for another contract, and you'll probably find one better than this one.
