I am a Canadian in the middle of buying a resale contract and the closing company (DVC Title & Escrow) sent me a document ([Part III, Ch. 692 F.S. - Conveyances to Foreign Entities - By Entity Buyer) to have notarized because I am a foreign buyer. Looks like it is just something from their own office rather than a government form. I've never had to do this before and the last contract I bought was in Nov 2023. Is this something new in Florida or just something this particular closing company wants?

I’ve never had to have anything notarised as a foreign buyer, the last contract I bought was a few months ago.

There is a relatively new FL law that requires foreign buyers to complete this form.

We are also in the process of buying and using DVC Title. I asked the same question of them after they sent it across. They got back to me and let me know it didnt need to be notarized. Might be worth asking.

I did ask them this and they said they would waive the notarization.

Thanks.

I have bought a resale contract recently as well as an international buyer but they didn’t even mention such a document and I didn’t need to notarize anything.

I’m in the process of buying we recently passed ROFR and all documents are now signed. No need to notarize anything.

I purchased a small resale contract at BCV last June, did not have to notarize anything. I'm also Canadian. I've had to notarize when I've sold a contract though.

I’m also being asked to sign and have this form notarised… hopefully they will waive for me too as it’s a pain! @DougEMG did you just check the box that says you are not a foreign principal? I assume that’s the right one without having to delve in to all the Florida statutes for definitions!

I just got asked today on this too. Were you able to obtain permission to waive it?

Its apparently new-ish. We were asked to sign and notarize is. I asked Closing company to clarify and they came back with just a need to sign it for their records (no notary required).

That’s good news, they do the online video notaries, usually at no additional cost to normal closing
Hmm… they have sent me a link to an online notary, but for an additional charge. This is the first time I have had to sign this form (it’s to declare that I am not a foreign national from a ‘country of concern’). Maybe I will go back to them and ask if they will notarise for free if they are suddenly desperate to check that I’m compliant (they haven’t needed this for the last 10 contracts!)

That’s a shame, I sold with them a few months back and didn’t charge, must be different for buyers

Just a bump this appears to be coming more common with a few title companies.

Does anyone know the actual rules. As some people have had it waved some charged for notary !?
