No Job for me yet..

as some of you know I haven't been in work since April due to a slipped disc /trapped nerves caused through restraining a pupil in school. anyway, i did resign from the job in December and looked forward to looking for a not so strenuous job!
i went to the back pain specialist on friday morning and he has advised me not to even think about a job until my back is sorted :mad: He did a thorough examination on my back and then told me i will be in a lot of pain for the next 24hrs, due to him aggravating the condition which has now happened:guilty:
I have to go for an indepth scan on my back and then we can go from there.

I am now getting so angry about all this and am now comtemplating claiming compensation from the council for all the trauma i have been through and loss of earnings, but I also don't like to rock the boat so to speak,
so any advice will be appreciated! I couldnt face going to court etc, and to be honest i really don't know what is involved in fighting the council. anyone got any advice help please!!

im so sorry that this is still causing you pain.....i think you must seek compensation as this is not going to be a quick fix solution.

A solicitor specialising in this matter would be the best person to advise you, its a long process though....my brother has only just settled a claim from a road accident 3yrs ago
 
Think i'll go to the cab tomorrow if i can drive! I am with unison, but don't want to involve them yet til I know whats involved.

I'm sorry to hear about what's happened, you must be in so much pain.

My Step Mum only recently settled out of court, after what seems like 4 or 5 years. That was after a car accident. She was in so much pain for so long. The pain was all down her spine, however after many examinations (over years) they couldn't find anything wrong with her back. It turns out - only discovered 6 months ago - the injury was in her neck and sending the pain down her back. She finally got an operation and is doing much better. She was only ever able to work part time dduring this period.

As others have said speak to a specialist solicitor, I know many have a frree first hour on offer.

Unison will have some specialists who deal with this sort of thing. They will be able to advise you on your options and maybe deal the council's insurers on your behalf (not sure exactly what they do now but I used to do this sort ofd thing for another union for a couple of years). It may be interesting to compare the advice they give with the citizens advice bureau!

I work for a county council and the only time they go to court is when they have no choice; always settle out of court; to much bad press and costs too much money. I suspect your authority will be similar.

Thanks for all your advice, I'm going to go the doctors tomorrow for yet another sick note and then i'm going to the cab to see what they say..
I am now getting so fed up of being in pain and having limited movement at times. being on tablets when i am in pain and not being able to lead a normal life anymore.I hope I have a strong case as this is the second time in the job that I have been injured in the past 2 years with the same thing.

you should do something as it wasnt your fault - that said if when you plan to return to work it will be working in a school or for council again it could prove difficult then.

I did think of that, but as I have resigned I don't think I will work for the council again!
 
Wishing you lots of luck in getting compensation, stay strong and keep fighting as they will draw it out in the hope you will give up.
