Need help ASAP

DH has direct deposit for his paycheck. On friday his amount that was depostied in our account was 644.36 LESS then what his paystub with copy of voided check said on it. He told the lady in payroll his deposited amount was short and she said that he had 3 days of vacation time a few weeks ago (these were days that were APPROVED and he was told he had the time), and he did not actually have the time so they took it out of his pay. OK so NOW our taxes and income are not correct! The amount for the three days does not NOT even equal that amount. We have nothing that reflects this transaction. Is this even leagal? How can they do that? There response was, file a greivence. Well, he still has an unresolved greivence from March of 2009.
 
Not sure if it's the same but my husband gets a check on the anniversary of his hire date. This is for his vacation pay. Any time he takes a day off/vacation day, it is deducted from his salary. They figure his pay on a six day week, not five, which I think is odd. I feel like he is underpaid for the time he puts in.

Is the pay bi-weekly? Did it include a holiday? His work is set up, usually effects Thanksgiving and Christmas, but if you don't work the day before and/or after, you don't get paid for the holiday--unless you take a vacation day. There were too many people on salary abusing this, they had to put a stop to it somehow.

My problem is the check and his taxes reflect what the check stub says but it is wrong. How can they just change the amount like that? they did not record it. Makes no sense to me.:sad2:

The amount is not even correct for the amount of time he was off. They are the ones that told him he had the time to take off. Yes, we both know it is his resposibility to keep track. We were out of town at the time and did not have any records with us. I guess they messed up vacation hours for several emplyees not just DH.
 
Is there any way to verify the time he had left? Our company has online tracking and reporting of leave. I can login and check my time and update if I take any. My super gets an email, accepts or rejects and it gets updated.

If we don't have time, we cannot take time off, or its unpaid leave.

We are not disputing the time off. We are upset that his pay is not what was told to the IRS.
 
They should be able to provide you with a corrected paystub. If you can't fight them on paying him for the vacation days, I'd at least insist on that.
 
Sounds like your husband works for the same company my husband works for (Verizon). He had the same problem and even before he took the time off he checked with both his superviser and HR. Then they come back and go oh we were wrong you did not have vacation time...so he had to use some personal days and floating holiday time to make up the difference in pay. I would file a greivance anyway and if he has a union follow up with a union rep to get things moving along. EIther way they have to reconcile the issue...just make sure he becomes a squeaky wheel...or he will be put on the back burner for who knows how long.

If the amount deposited in the bank is different than the amount on the paystub, then HR needs to fix that asap. Either he gets a new check stub with the correct amount that was deposited in the bank, or they need to deposit in the bank the amount on his check stub. I work in HR, and these two must match. If they refuse, then you need to take it to the labor board in your area, because they are cheating people.
 
Check both your state and federal labor laws as well as IRS rules for employers. I do not believe they can legally pay out, through direct deposit or check, an amount that differs from the pay stub provided. Sounds to me like they are attempting to pull a fast one. I would not only demand they fix the error but also provide an accurate accounting of vacation/personal/sick time since there seems to be so much confusion on both sides.

My DH is salary plus commission. That commission is determined through a complicated series of rules and calculations. Difficult to compute accurately for us. We can only ball park. His company changed payroll providers and they overpaid his commission one month by about $600. We had no idea. Two weeks later we were notified of the problem and told that we could elect to have it adjusted from one paycheck or three. We chose three (free short term loan). So for the next three months 1/3 of the amount came out of his commission checks, all clearly notated on his pay stubs. My understanding is this is the legal way to fix mistakes.
 
If they treated the vacation as unpaid leave - which it sounds like they did - then the paystub should reflect the lower amount. They cannot issue the paystub for one amount, then deposit something lower. Sounds like the payroll person does not have a clue - time to read them the riot act.
 
Paystub needs to match.
Companies can get into HUGE trouble for recording they paid you differently than they did. It would not have been reported to the IRS yet, but they need to at least get you a paystub that reflects his actual compensation.

Once that is resolved, then I would look into the vacation time thing.

Make sure you print out a bank record or keep your statement showing the deposit!

sorry I misread slightly. I was mentioning that if he was told he had the time and then they say he didn't, to look and see if he actually did, rather than believing in them.

As for reporting the different figures, I can see that what they are trying to do is report you with normal pay, and if you HAD time then your paycheck wouldn't be affected. however then they tried to remove the pay of 3 days from your check, and report as if you had the time. I don't believe they can do it. It has to be reported what is given.

i would call the IRS if they are giving you the runaround.
