Man Sues Over Mickey Parade

Not going to really argue this suit but I agree that curb by casey's is really hard to see in normal night lighting if stepping down. I trip on it almost every visit so hopefully that will get a little better :)
 
While mainstreet is fairly well lit (except during shows and such) I'm continually surprised at how "unlit" a good chunk of the park is at night. New Fantasyland, Liberty Town and Adventureland walkways are all very dark at points and I'm surprised more accidents don't happen even with no sidewalks in those areas.

That said, I LIKE it dark but some small amount of ambient lighting on the pathways would go a long way.

As for the lawsuit - the devil is in the details but if it's dark out and he faceplanted because he wasn't watching where he was going because he was pushing his way around for a better view of the fireworks while carrying an ipad over his head... well that's HIS fault. :)
 
Do they turn the lights down/off for the Christmas parade? ? I know they do for MSEP. I see this suit getting the heave-ho by the judge in any case.

Not "all" of them like for the MSEP.

In fact, they add spotlights from above the buildings in the darker areas (Frontierland, etc.)

They, of course, drop the lighting for Christmas Wishes and Celebrate the Magic.

Disney World is NOT "The Most Magical Place On Earth" for one man who says he was severely injured ... not on a ride, but while watching the dreaded Christmas Parade.

Michael Amabile claims he was at the Magic Kingdom in Orlando last December waiting for "Mickey's Very Merry Christmas Parade," when he tripped over a sidewalk.

According to the suit ... Michael says the sidewalk could not be seen due to all the lights being turned off, and Disney cast members never warned him about the elevated step.

Amabile doesn't specify his injuries in the suit, but he wants the Mouse to pony up big money for his medical bills.

A few turkey legs wouldn't hurt either, we're guessing.

More like looking for free annual passes and FP's. Another fall, another ticket price increase coming around the corner. All can be solved with Tort reform. Obviously people don't mind paying higher prices and frivolous law suits, because they can be cured at the ballot box, so there's really no room to complain here. Not that you're complaining, others here are however.

A lot of times, insurance companies are at the center of these lawsuits. His insurance and Disney's are arguing about who is going to pay.

I fell at Universal once and had a nice hospital bill as a result. That one was my fault - DD took off suddenly to find a bathroom, and I was following. The curb I tripped over was painted a bright color. My insurance company asked all kinds of questions to determine who they thought should pay.

I hope Disney bans this moron. And what a gutless wonder - "I tripped over a sidewalk because of my own clumsiness, I better sue and make a profit off this. So what if I look like a wuss." This is the something for nothing generation. I've fallen in public before - this reaction was never even a blip on my radar.

It's interesting because blacktop seems to be what's typically used, being a typical thoroughfare and all but I wonder if they couldn't use more flexible material like they use in playgrounds these days.
(As for hospital bills, I hear ya... my mother tripped on the driveway to her car (concrete) and fractured her wrist to the tune of several thousand dollars of bills and weeks of physical therapy)
 
Never been at christmas time, but I know when they are getting ready for the electrical parade and they dim the lights they make an announcement over the loud speaker for everyone to pretty much stay put or be careful while moving around because of the reduced lighting factor. Not sure if this guy will get anything out of it bc its his own fault for not watching where he was going. People are so sue happy its ridiculous...whatever happened to taking responsibility for your mistakes. Thats whats wrong with the world today...if something happens or if something goes wrong its always someone elses fault

For me, it comes down to personal responsibility. If it gets dark, pay more attention where you are walking. You know the curb existed when the lights were on. They did not go away when it gets dark.

I say we need to ban curbs! It's time those deathtraps were forever removed! What good have they ever done?...other than creating sidewalks that prevent people from getting run over by cars....

The article doesn't tell you that he bull rushed five people, knocked them out of the way, drop kicked a toddler, then tripped over the curb.

I'm curious to know how he managed to hurt himself on a crowded walkway. How did he actually manage to hurt himself if the sidewalk is crowded? How did he actually manage to even find sidewalk?

DS got injured twice in 3 months, with ER visits. Both times we got letters from the insurance company, basically asking us who caused this. Basically to find out who they could sue (or make US sue) to get out of being the ones that paid.

Different sort of insurance, but back in the 80s two of my lifelong classmates (who were the best of friends to each other) ended up with their families suing each other. One of them moved the others car (with permission) when there was alcohol involved, the car-mover hit a tree. It ended up with the car owner family suing the mover family and nearly destroyed a friendship. They didn't WANT to sue, but the insurance companies were involved and it was out of their hands. (please note I have a high school gossip understanding of what happened, this is not gospel)


Just because people want to ridicule those who file lawsuits doesn't mean they are all wrong. Just because people here want to pretend like nothing could EVER be Disney's fault doesn't mean it isn't sometimes their fault. Tort reform (according to my SIL who should know) has nothing to do with lawsuits being *filed*.

A friend from here...she and her mom were scootering back to PPH at Disneyland, and there was an area of the parking lot where it tilted two different ways at once (I've walked it, and it's a WEIRD spot). At night, it's perfectly in shadow based on how the disney-installed streetlights hit it. Her elderly mom hit it (in the dark) just right/wrong, and fell over with her scooter. She righteously had some long chats with them, because that sidewalk/driveway spot was WRONG. I'm pretty sure it has been changed in the intervening years, and that is GOOD.

There are some areas of Disneyland, and some areas of the rundisney event areas that are shockingly dark. Like no public place where you are walking or standing should be that dark, dark. (most likely at non-event WDW, too, but I haven't actually been inside the parks in awhile and I don't like WDW's parades or fireworks so I don't wait for them, and I don't know or remember) If someone were to be injured there, IMO a person is totally in the right to have disney pay. (or Universal in JCMM's case above)

This guy MIGHT have been the doofus most here think he is. But he might not have been. This might be totally righteous and suit-worthy.
 
NO matter what Disney does, some people only see their "payday" and will do near anything to get it.
