Landlords-advice re evicting a tenant

We had an issue like this when we sub leased our apartment and it was a nightmare to get the tenant out. We are in a different state but non payment of just one month is even hard to evict on and our lease with our tenant was up in four months when we tried to evict him. Long story short he was still living there two months after his lease ended and still not paying and the law was on his side because we were waiting for a court date. We should have just waited for the lease to expire or offer him a buyout such as not paying that months rent if he left. BTW we never saw any of that rent money despite a judgment and it has been more than two years.
