Jury rules for Disney in Tower of Terror case

Cohen might appeal. His lead attorney, Barry Novack of Los Angeles, said afterwards that he was disappointed that Judge Jose R. Rodriguez's rulings before and during the trial prevented Cohen from pursuing all of his claims, chiefly that the ride's warnings misled him.

I may not be remembering the warnings from back then, but I'm pretty sure they didn't say, "Sit back and enjoy a lazy ride through some calming scenes from a classic TV show..."
 
If it happened in 1998 why did he wait until 2002 to file the lawsuit?? :confused3
 
Hello! Does the name Tower of Terror not imply a thrill ride? Did the screams while waiting not alert him to a thrill ride? Some people.......
 

I heard about this case a couple of weeks ago and apparently this is an attorney that makes a living suing Disney.

Exactly, you can hear the screams and see people dropping inside the ride from the entrance to the ruddy park!

If you are likely to have a stroke- read the information before going on the ride! Disney puts all its information in both the park guide and before you enter the queue line.

A stroke is a horrible thing to have to go through, but it is a fact of life. He should count himself among the fortunate few who survive and have a chance of their life back. Go enjoy the life you have been kept with, and stop wasting that precious time trying to blame someone that you know has absolutely no fault.

Sorry for the rant, but people want to blame everyone else for the risks they take in life; for the fact that they are human. Well tough, we are all human, are bodies are not machines- sometimes luck isn't on our side. It is no ones fault, move on and accept that life throws you curve balls- doesn't mean you have to sue!!
 
there are warnings all over the place at disney....
they even tend to overwarn, not the other way around...

and it's not as if excessive warnings weren't around back when this guy claims there weren't any.....

i remember visiting WDW alone with my kids back in 1995 (DH couldn't get away that year)...
i was just after a serious medical issue so i paid special attention to the warnings on all the rides......

to give you an idea of how much disney over-warned even then, we were afraid of going on alien encounter because of the warnings regarding medical issues....
and you remember how dangerous that one wasn't.... :rolleyes:

and anyway, you have to be an idiot not to realize that a falling elevator is a thrill ride...

how old was this guy then? he's 80 now, so he was bout 68 when he claims it caused him a stroke - which by the way, only occurred several weeks after he rode the ride....
well...geez...you know...if you're 68, maybe you should think twice?
i'm 54 and i think twice....when i'm 68, i'm assuming i'll think 3 times before getting on something...
especially when they have very clear warnings before you ride...

How does he know it was the ToT that caused it? Maybe it was spending all that time with his family that caused the stroke! :rotfl2:
 
My question is this....if he was on the ride in 1998 and had the stroke in 1998 then why did he wait 4 years to bring the lawsuit. Could it be that it took that long to find a lawyer willing to sue on his behalf? Sounds fishy to me.
 
It was also mentioned that this person had some health problems before ridding Tower of Terror, so WDW claimed he should have read the warning signs posted before going on.

So glad my body isn't a machine. I have to upgrade my computer every two or three years cause it is obsolete. How'd you like a three year life-span? :scared:
 
This guy was 80 and it happened like 12 years ago so I'm thinking either a lawyer or his family talked him into it. Who knows how much he actually had to do with it.

Hey, at least we are not a May fly! They can live for only between 30 minutes and one day!

I cant even get onto Toy Story Mania in 30 minutes if I get there at opening! :rotfl:
