Is it possible that BCVers will NOT be able to use SAB someday?

I know some of you legal types have actually read the contract. Is it possible? What happens when DVC is done building and is out of sales mode? What happens if DVC is sold to an outside company like Marriott?

I'll be rather peeved!!! Since we chose BCV over VWL cause of SAB. Hope someone knows the answer to this...
I never even thought about this...
 
I'd be peeved too, but I'm peeved about a lot of things and that doesn't stop people from peeving me! :p
 
I doubt if DVC would ever be sold to an outside organization. If they did it could seriously compromise Disney's autonomy with RCID (Reedy Creek Improvement District -- created by the Florida legislature in 1967 granting Disney most of the powers relegated to a county such as zoning, utilities and emergency services).

I also doubt that SAB is an issue. It is the main pool for that resort and BCV is part of that resort.
 

my guess is that just as access to SAB is currently limited to folks staying at BC in general, in the future, they could make it just for the non-DVC portion. I'd figure that if both YC and BC hotels were filled, they might try this.

I don't think using SAB is necessarily included with your DVC purchase at BCV - BCV does have it's own pool. Using SAB is a privilege just as pool hopping wherever you wanted was once a privilege. Privileges can be taken away if it is not explicitly stated in your contract that it cannot. If SAB and/or BC hotel facilities are not mentioned in your contract, then it is possible that they could be taken away (though I highly doubt they would) in the future.
 
Yes SAB is included in your purchase. It is described in your component site public offering statement. Unless they can build another pool that fits the exact description in the offering statement, we will always have access to SAB as a legal right.

I hate to say it, but SAB was WAY too crowded when we were there last week :( We only attempted to swim there once. We ended up pool-hopping the rest of the time because there were just too many people in the SAB pool to actually enjoy ourselves. I would be really peeved if I paid $300+/night for the YC or BC and then had to fight for a beach chair at the pool. SAB is a very popular pool...I don't know if the implications of giving essentially 3 hotels access to this 1 pool were properly considered. I don't know if they could ever discontinue BCV privledges at SAB on a going forward basis, but in hindsight, they might have been wise to build a bigger BCV pool and make SAB off-limits to BCV guests. JMTCW...you might want to take it with a grain of salt, too, since DH and I are still disappointed with how packed SAB was during our vacation;)
 
SAB is designated as a pool in the official disclosure documents as for BCV use. As a result, legally, there are only two ways SAB use can be taken away from BCV owners -- the pool is closed for use to all (YC/BC/BCV) such as by a decision to build a new one or rebuild that one (or just temporarily during refurbishment), or 60% of the BCV owners vote to take away their right to use SAB (I am pretty sure that is not a vote that would be easily got).

They could always elect to expand the SAB pool area with additional attraction type pools directly adjacent to the area. The GF addition is nice, a grotto type pool with a slide and "o" entry would proviede extra SAB pool space.

I'm glad they are enforcing limitations on who is appropriate to use it, there have been abuses by local pool crashers in the past.
 
I would think BCV would not have sold quite as well and fast if SAB wasn't a privilege. If they took that away what about the main themed pool at BW or WL? Woudln't be fair at all to BCV owners.
 
lenshanem...it sounds like it's a moot point and that BCV owners are safe with SAB for the duration.

But, in response to your comment, I'd like to add that SAB was available for pool hopping and part of the sales pitch when DVD was selling OKW, BWV and VWL. So the "not fair because it was part of the sales pitch" aspect of DVC is not going to hold water (sorry for the bad pun).

I'm not particularly disappointed in not being able to use SAB when staying at VWL or BWV, but I'm sure some who stay there are upset when they felt this was a guaranteed perk based on the guide's sales pitch.

Bottom line...if it isn't in the contract, they can do whatever they want. Fortunately, SAB is in the contract for BCV! :)
 
disney is not likely to sale the DVC - remember that Disney gets it back in 2042 - and despite what some members think - I really believe that Disney will take it back and start renting them out. Well BWV, BCV, and VWL - OKW is big enough for them to do something else with if they want.

of course no one can predicted the future.
