Interesting twist in the Wal-Mart stampede story

A woman reported "trampled" last Friday by Wal-Mart shoppers desperate for $29.87 DVD players has a long history of claiming injuries from Wal-Marts and other businesses where she worked or shopped.

Patricia Vanlester, 41, was knocked unconscious and, her sister said, "trampled by a herd of elephants" by a stampede of shoppers reaching for DVD players that went on sale at 6 a.m. the day after Thanksgiving, according to Orange City police and the sister, Linda Ellzey.

An investigation by WKMG-Local 6 reveals Vanlester has filed 16 previous claims of injuries at Wal-Mart stores and other places she has shopped or worked, according to Wal-Mart, court files and state records. Her sister, who accompanied her Friday on the visit to Wal-Mart, has also filed a prior injury claim against Wal-Mart, with Vanlester as her witness, a company spokeswoman said yesterday.


Asked whether Vanlester's frequent injury claims might cast doubt on the veracity of her latest allegation, her attorney, David L. Sweat, of Port Orange, said, "No comment." He did stress, though, that Vanlester "has not filed a claim nor have we decided to file one" related to last week's incident.


Wal-Mart is reviewing store videotapes "as we look into the claim," spokeswoman Karen Burk said from the massive retailer's Bentonville, Ark., headquarters. "We will investigate this claim as thoroughly as we have the other 10 claims that this customer and her sister have brought against our stores in the past."


Vanlester, who worked at Wal-Marts in Mt. Dora and Orange City in 1996 and 1997, declined comment through her mother, Barbara Rastellini, with whom she owns a home here.


Vanlester spent at least two days in Halifax Medical Center in Daytona Beach last weekend and today was back in the hospital "having a procedure done," Sweat said. He did not know if the procedure was related to the Wal-Mart incident.


Vanlester has for years complained of head, back, neck, leg or arm pain caused by slipping and falling, objects falling on her and other accidents, according to medical records in a public court file examined by WKMG-Local 6. In fact, her sister says she was wearing a neck brace at the time of last Friday's incident because of injuries from a years-old car accident.


According to state worker's compensation records and court files at the Volusia County courthouse in DeLand, here's some of what Vanlester has claimed over the years under some of her various legal last names: Rastellini, Findley, Crabtree, Platt and Vanlester.



In 1978 and 1982, more than $400 in worker's compensation was paid after she claimed injuries from being struck by a falling object and from slipping and falling while working as a machine operator at a now-defunct manufacturing plant in DeLand.
In 1984, she claimed a back sprain from working at a restaurant in Winter Haven, producing $356 in worker's compensation.
In 1987, she filed an injury claim against Deltona Lanes, a Volusia County bowling alley, after claiming she slipped and fell while bowling there. In a 1993 sworn deposition in another case, Vanlester testified she received a cash settlement from the bowling alley claim, but did not recall the amount.
In 1989, after her car ran off Interstate 4 in Volusia and overturned, she filed a claim against Big T Tire and Wheel Service, of Orange City, claiming the crash was caused by a tire blowout. She testified she received a cash settlement in that case, as well.
In 1991, she claimed to have slipped on a puddle of hand lotion while shopping for a curling iron at an Orange City Walgreen's, causing "permanent injury, disability, disfigurement (and) mental anguish." She filed suit in 1993, but it was thrown out in January 1994 after a 10-minute hearing. Walgreen's argued no one at the store had seen any liquid on the floor, so it could not be liable for failing to clean it up.
In 1995, Vanlester reported slipping and falling on liquid or grease while working in the meat department of a Eustis Publix, resulting in more than $1,200 in worker's compensation.
In 1996, she claimed to have slipped and fallen while working at the layaway desk of a Mt. Dora Wal-Mart, leading to more than $600 in worker's compensation payments.
In 1997, she claimed a back strain while working at the snack bar of an Orange City Wal-Mart that was replaced by the Wal-Mart Superstore where she claims to have been trampled last Friday.

Burk, the Wal-Mart spokeswoman, said she could not reveal exactly how much Wal-Mart has paid in medical expenses and direct payments to Vanlester as a result of her nine claims, but said the total was in the "thousands."


Nor could she provide details on the injury claim Wal-Mart received from her sister, Ellzey, 48, of Inglis, Fla., except to say Vanlester was listed as a witness to the injury.


Ellzey said in an earlier interview that Wal-Mart should have foreseen the danger of unleashing shoppers on a huge bargain at 6 a.m. the day after Thanksgiving. "For several years, every time they do this, people get trampled," she said last week, adding, "I'm panicked. I'm afraid to go into any stores, especially Wal-Mart."


This week, Ellzey has not returned repeated calls seeking comment. But her widely-reported characterization of the incident last Friday as a trampling by a "herd of elephants" has provoked much comment around the world.

The more I think about it, if you WERE going to fake an injury, then that would have been a good time to do it with all thsoe people. Will be interesting to see how it plays out.

P.S. My brother's ex has a dh now who seems to ALWAYS be out of work on workman's comp - another one who is either real sleazy or unlucky, but I vote for sleazy...
 
You know, after all that, I think I would be scared to go out of my house. Not that I think any of that is legit. :rolleyes:
 
Amazing and unbelievable how many 'slip and fall' injuries one person could have...hmmmm. ;)


I wish they would prosecute people like this for fraud. They affect the bottom dollar for ALL of us.
 

Well, you know what happens when you play "wolf".....The time you really *are* hurt, noone believes you...........:rolleyes:
 
You know, my initial inclination is to disbelieve this woman.....however, I *do* know someone who was simiarly unlucky, so there's a part of me (albeit a small part) who believes her claims may be legit. My friend hurt his back lifting weights; then was in a car accident that aggravated that injury, and resulted in him needing surgery....then he had another accident nearly IDENTICAL to the first one (in both incidents, someone backed out of their driveway onto a very busy road, right in front of him...the first one was a 16 year old girl who had just gotten her license; the second, an 89 year old woman whose own daughter said she shouldn't be driving). THEN, at work, he tripped and fell--cracking the fusion he'd gotten on his spine. It was crazy. He *was* afraid to leave the house for a while, convinced he was cursed.

Whomever is right in this case, I hope justice prevails! (And that that woman is smart enough to never shop at Walmart again!)

I agree.

I know of a few people who know how to "work the system" so to speak. They know exactly what to say and do, and it helps if you have someone to "witness" the so called accident.
 
Well, this background information certainly casts some doubt on the legitimacy of her claim, even if it is legitimate.

The woman is either very good at working the system or has Munchausen's Syndrome, and gets off on being sick, getting the attention etc. I have a SIL who I think has that. If someone in the family gets sick, she always has a worse ailment that starts within 1-2 weeks of hearing about the other person. My DH's cousin is currently hospitalized with a lung problem which we found out about 5 days ago. My guess is that my SIL will be becoming sick very soon.

When my DFIL was scheduled for cardiac bypass a few years ago, this same SIL called my DMIL the night before my DFILs surgery to tell her that she had just been to the doctor because she was dizzy and he ordered a CT scan of the head because she might have a brain tumor. I said to my DH, when I heard THAT story, "I'd be home from the post-hospitalziation rehab after my brain surgery before my mother would have ever known there was a problem". But no, SIL saw someone else(DFIL) was going to be getting attention, and...VIOLA!...a possible brain tumor popped up!!!!! :rolleyes:

Well, here's my 2 cents. She is most likely a scam artist. However, if that newspaper report from last week is true as far as her injuries go THIS TIME, then she probably, finally, wound up with a legitmate case. I know enough medical ppl to know that its abit hard to fake unconsciousness as it is. But a seizure, is impossible to fake, You've either had 1 or you haven't. a CAT Scan will be able to prove or disprove it.

BUT, her previous scams probably mean that the 1 time she has a legitimate case she'll wind up with little or nothing. I doubt she'd be brave enough to go in front of a jury with her past. And this 1 will probably reopen a lot of old investigations about previous claims. Can't wait to hear more about this case. Should be fun LOL

It sounds like she was trying to set them up, and finally went too far and got hurt for real. Hopefully Wal Mart won't have to pay her one red cent.
 
...and all the responses on the earlier Walmart thread show why she gets away with this crap. People are very quick to blame the big corporation with no facts to back it up.
 
And to think I felt sorry for this person. I do believe that she set it all up and it didn't work as well as she thought. I hope that they sue her
 
I don't recall anybody actually blaming WALMart for the incident. I do recall ppl stating that they thought the response of "We'll hold the DVD player for her" was a bit out of line. Which it was based on the information we had at the time. Even based on this new info. it still looks as though the woman was legitimately injured THIS TIME. Whether she planned it or not.

Is she a scam artist? Most likely. Did she scam the store last friday? Probably not. Did she plan to scam the store? Who knows?

But this is why any store conducts a complete and thorough investigation when somebody files an injury report. Anybody committing fraud sould be posecuted.

I still will never shop WALMart though. I hate the store and its shortcomings are legion.

It certainly appears that she has a long enough history of "slip and fall" type accidents that her credibility is very suspect.
Her sister was a witness to this one. The sister also has had some similar type claims.

Hummmmmmmmmmmmmmmmmmmmmmmm!
 
Thanks for sharing that story. It's people who scam that make it difficult for those with legitimate problems get any satisfaction.

Maybe Wal-Mart needs to rethink that "only #number items available" philosophy. I know people won't change!!

I think this woman is trying to pull a fast one over everyone....how many lawsuits against Wal-Mart can you do??
