My oldest DD (24) graduated college Dec 09. From Jan-June she worked as a long-term sub. Over summer, she worked for the Special Rec division of our local park district. In Aug, she started a full-time teaching position.

She still lives at home (rent free for the moment). She does pay her car payment, credit card, car insurance, her portion of the cell phone and basic stuff. We still pay for all of the food (unless she goes out without us), utilities...

We really need to claim her on our taxes (long story) but I don't know if we legally can or not.

Any thoughts?

The answer is no.

There are five tests, all of which must be met to be allowed to claim a dependent. The one she clearly does not meet is: Under the age of 19, or, if a full-time student during any part of at least five months during the year being under the age of 24.

Since she is 24 she does not qualify. Since she was not a full-time student during at least five months during the year she does not qualify.

Mike, CPA

I am not a CPA, but I agree with Mike the CPA.

I had to hire a CPA last year to help me make sure I could deduct my son as a dependent........and the CPA's tax preparation fee was more than the deduction was worth.:scared1::eek::scared1:
