How Often Does Seller Drop Out?

Thought we found the perfect add-on resale contract, but now the seller has disappeared. We made an offer that was countered and we declined. A few days later the seller's agent contacted us about another offer and we stayed firm on our number which was accepted. We signed our contract and have been waiting on confirmation all week that the contract was sent to Disney for ROFR. The agent has been unsuccessful in getting the signed contract back from the seller and cannot get a hold of them.

Holding out hope they maybe went on a Disney cruise or something, but I fear they had sellers remorse and decided to keep it. Would like to find out either way, so I can begin shopping around or move forward on this contract.

Anyone else have a similar experience lately?

When I was selling my first contract I got sent on a 2 week business trip so couldn't sign documents as I needed to be in the same place as my husband and I was on site with no wifi. When you list a contract you don't know when it is going to sell and life comes first.

But if you have backed a seller into a price they were not happy with they may have had second thoughts and be pulling out.

True, you might have spooked the seller but you would think they would've just declined your offer so you both could've moved on . You to the next contract and them to the next buyer.Good luck your contract will show up.

That was my thought exactly. We had moved on to other contracts, and this seller asked their agent to reengage with us. I started to liquidate some assets to prepare for the purchase, just would like to know either way.

I would imagine that Minniesgal (or her husband) at least told the agent of the reason for the delay. If the seller is this slow at this point, it may be best to back out at this point. There are plenty of contracts for sale. Maybe the sellers have some situation that is precluding them responding to the agent or whatnot, but the inherent waits in this process are long enough without having the other party drag his or her feet. If the seller hasn't signed the contract, you can back out at any time.

I just contacted the agent and told them that I will give them until the end of day on Monday to at least make contact back with the agent. If not, we will pull the contract and start the hunt again.

Just heard back from the agent that the seller had an accident and hospitalization and that everyone will be ok. They sent in the paperwork this morning and the contract is on its way to Disney.

I feel bad questioning where they went now, but glad it is back on track. The nerves with the resale process always gets me a little amped up.

You shouldn't feel bad. Your actions were understanable and you gave them an opportunity to respond which they did. You were far more patient than most and as a result, they got to keep the contract in effect. Thankfully they will all be okay.

Offer and acceptance creates a valid contract IF it is supported by consideration. In this case, your promise to pay and the seller's promise to buy are likely sufficient.

But I'm glad it worked out :)

Not in a contract for real estate.

How much time was given in the contract for both parties to sign? I know we had a date in our contract by which both parties had to sign. I think ours was about 7-10 days or so. Once that date comes and goes, you can start shopping again. I would reach out to the agent and ask them directly. I know it is not indefinite.

Nice! I wouldn't feel bad. You had no idea. At least it is moving forward.
