I'm guessing it's because some people have severe reactions to such high levels of... er... spiciness? Plus the fact that that kind of heat can burn your mouth just as surely as if you'd drank boiling water. My (now in his late 30's) half-brother ate a tiny Habanero pepper when he was young and it blistered his tongue, his whole mouth, and even into his throat and nose! I suppose they don't want anyone suing the restaurant if that happens to them.
