How do I add name to deed?

I've had a contract for a few years and would now like to add someone to it. How do i go about doing that? What is the cost? How long is the process?

It is similar to doing a real estate closing. The listed owners need to transfer their interest to a new deed that has the currently listed owners on it plus the one you want to add. Note if you have an existing mortgage on the timeshare, you will not be able to do it without paying off the mortgage. You have to pay any taxes and fees to the government entities required by the transfer and recording of the deed and you need Disney to sign off on its right of first refusal (which it will automatically do unless this is a sale). I believe MS (accounting or records) can actually provide you some info on how to do it including forms, and title and closing companies also provide the service for a fee. Total cost should not be much but there are costs.
 
We have been considering adding my Mom and I was told $425 to have the Lawyer change it. That is from MS.
 

The process is simple and can easily be done by an individual in this situation. As noted, one either needs to have no mortgage or get the approval of the mortgage company to add a name.

  • Contact DVC to get the initial transfer paperwork.
  • Complete said paperwork and send to member admin.
  • Once ROFR received, send that and the signed deed to the county for recording along with the associated fees.
  • Once recorded, DVC has a different form to complete to send along with a copy of the recorded deed.
It really is that simple. One just has to decide if they want to do it themselves or pay someone to do all or part. One company will do it as low as $75 plus recording costs but not all will do the ROFR or may charge extra. OC has a FAQ page with deed requirements and recording costs. It was $10 for page 1 and $8.50 for each page after last I checked. Deed and ROFR would be separate documents so each page 1 is full price. Remember that a deed requires 2 witnesses and while the notary can witness, they must sign separately as a witness for it to be counted.
