help with ADA

Hello, everybody,

It's been a while since I posted, but I "lurk" quite a bit. Being an orthopedic surgery resident, as well as the dad of 5 year old triplets (2 of whom have cerebral palsy), takes quite a bit of my time! I appreciate all of the advice and "pixie dust" that is passed around this "community", and I always feel comforted when I visit.

We DID go to WDW last spring, and (shame on me) I have not posted all the wonderful details of what all of WDW did for my kids. I promise to pass all of those special moments along in a later post.

I'm here today for help. My kids started school this week, and one of the things that my wife and I have dreaded has finally come about: my kids came home today and cried because they did not get to go outside on the playground like the other kids. We had met with the principle and teachers, and had a great IEP meeting. We knew that the playground was not truly accessible, but we thought the teachers would do more to help include our kids...they promised that they would do more.

Please, anyone, please help direct me to web sites and info on the ADA that can help arm me and my wife with our meeting with the principle tomorrow morning. We were so hoping to not need to fight with the schools, but we now realize that if we don't fight for our kids, then they will be left behind.

Glad to hear from you, but sorry to hear your boys had such a problem with the playground. :(

This organization is the Parent Advocacy Center for Minnesota and is an example center for other similar organizations throughout the US.
 
You don’t need the ADA to help with this one. It’s as simple as the school can not discriminate against age, color, religion or disability. Public schools are state funded and under the law have to state in the Schools Code of Conduct the anti discrimination statement. The fact that all the other kids were allowed to use the playground equipment and yours weren’t is discrimination. Make and I do mean make the school accommodate your kids on the playground. If that means they have to buy a bucket swing or a swing with a back on it so be it.

When my 12 year old was in elementary school she was the only kid in the school in a wheelchair she decided she wanted a swing the PT found a swing and they installed it for her. She also had a playground bag that the school system provided with things in it that she could do from a wheelchair that could also include kids that weren’t in a chair.
