Height Restriction on MIB--40" or 42"

I've read conflicting information about MIB. What is the height restriction? My youngest is *almost* 40" so he'll be able to go on a lot more rides than our last visit, including my husband's favorite, Spiderman, but I'm thinking he won't be tall enough for one of my favorites, MIB. Notice I have lots of favorites!
