Good News/Bad News

Well, Firstly, I want to thank you all for all your help and information. You were all a huge help to us.
Good News...I didn't think we could do it BUT we did get up all of our deposit for our DVC purchase :cool1: This was an important thing for me and even though my hubby was back and forth on it, he agreed to DVC in the end!!!
The Bad News..... It's all going to our lawyer... plus more!!!!!!!!!!!!
Our WONDERFUL neighbor built a large building on part of our land. We spoke to him several times about it but he kept building. He actually had the nerve to tell us we HAD TO quick deed the property to him.... Yes, just GIVE HIM THE LAND!!!!!!!!!!!Then we go to City Hall to start action. City Hall even had him(neighbor) go to a hearing and told him to take it down.... Apparently, he feels he's above the law and we're told now this means we must secure a lawyer and start some sort of proceedings. That is going to mean $$$$$$$$$$$$$$ all of our deposit PLUS MORE!!!
I guess I have to now pay for this problem and then save again for DVC. :sad2: That's okay, things will work for the better, even though right now I can't see it through this disappointment. Maybe we can buy in after this is over... Maybe there will be a new DVC being built....Maybe even a resale...
Again, I thank you for all and I'll still be hanging around learning, posting etc... just not as an owner...
 
Sorry to hear your news--what a jerky neighbor! Hopefully you can get attorney's fees from him. Did he get a permit? If not, maybe the city will fight the battle for you. You will NEED a trip to Disney before all this is over. Best wishes to you.
 

Absolutely, part of the deal should be if things go in your favor, he must pay for all legal fees!

I'm sure you're right and things will work out for the better, just try to look towards the future when this ugly mess is behind you!!!

I'm not a Lawyer, nor did I sleep in a Holiday Inn Express last night!

IMHO:

If your neighboor is violating township ordinance, it is up to your township officials to enforece them. You may wish to gentlyremind them of this fact via a pleasant phone call. If no results, an editiorial in your hometown paper will light a fire..... er get them moving.

I believe you may also have damages from this neighboors actions, and could recover more than your Attorney fees. Were I a cinic, which I clearly am not, I would goto my family Doctor complaining of the difficulty sleeping, increased stress, heart palpitations and lack of marital companionship duw to stress and fighting, all caused by this neighboors actions. Then get a referral to a Psychiatrist, and repeat the story (Fill the Zoloft/Xanax Rxs, but flush em down the toilet)........

Seriously, keep documentation of your discussions with the neighboor, send letters via certified mail (return receipt requested), tape (if legal in your State) any and all phone conversations with this person.

:grouphug: I feel your pain. DH uncle, the land all used to be owned by DH Grandfather, lost his brain last year and decided to just build his house on a lot behind us because he felt he could. The lot was not big enough, septic was illegal, too close to water, running water going directly under his house etc. I kept my tongue until I realized his septic would be leaching into our yard, then I sent a letter to the town hall. What a joke, because he had already built it they basically made him jump through some hoops for show and let him finish it. He was furious because he knew it was us...I don't care I went through the nightmare house land thing in 1987 for 4 years and was not going there again! :furious: So he finishes this house moves in and hangs a pipe out his cellar window down a slope into our yard with running water going into it to keep his cellar kind of dry! :furious: DH takes care of that, it take 4 or 5 times but hopefully he will not do that anylonger. I did not have to go the legal route with this but did in 1987, what a joke! Get a good lawyer who specializes in land disputes. We used our family "friend", we were very young and stupid and got umm how do I say screwed,lol. Small towns like I live in do what they want as can be seen by DH uncle. I pity them when they try to sell it though, ain't gonna go through because nothing is legal. :rolleyes1
 
So sorry to hear Ms Mouse. Here's hoping this will all pass quickly and fairly painlessly. What a cruddy and somewhat delusional neighbor you have ! :sad2:

He can't force that. I would start with the town to see if there was a permit then with the building code enforcers to see that it is torn down.
 
So sorry....was looking forward to having you as our "next door neighbor"....I'm hoping your near future brings you back into the DVC world and we can welcome you as our neighbor! Good Luck and God Bless!
 
Ok, I had to tell my guide today that it's off for now BUT NOT FORGOTTEN!!!
I went to City Hall and my neighbor was told that the building has to come down by April. It's not only built on a portion of our land but actually built on a piece of wetlands so not only is planning & zoning involved BUT inland/wetland commission is also involved!!! He was down there (city hall) yesterday trying to schmooze them because he knows many people "downtown" BUT I was told today that they will do their best. If the building is not down by April, they will start citing him $150 at a time. BUT IF he's the person he is... thinks he's above the law....the city hall told us we may still have to seek legal help AND a surveyer!!! Well, that's okay we need a surveyer... the neighbor to one side is taking our land and the one on the other side is telling us we owe more than we think on his side :confused3 :rotfl: Well, I thank each of you for your concern, thoughts and wishes. I tell you all this though.... for sure, by next year (or at least by the end of next year BUT hopefully sooner) we will be "neighbors" :grouphug:
 
Sounds like he is related to my neigbor! GOod luck, and I still think the township/city/county has some liability in this if they issued the permit. Enforcing the law is not your responsibility, but theirs! Looks to me like two law suits might be in order. Is this a commercial building or home? Just be sure you get a good attorney who is familiar with land issues.
