Gator Bait

No matter what we do there is no way we can, or even should try to, make it impossible for stupid people to kill themselves. Unless people are routinely falling off of it, it is safe. One dumb, and drunk, man falling off of it and killing himself does not make it a hazard.

It's worse than that in this case. He knew he was going to the edge of the pier to take a leak into the lagoon.

I really cannot comment on what a jury or judge would do in this case, but is it too much to ask to have a ladder at the end of a pier. We have one at our dock in NH for just the case of someone falling in. And if that person was drunk or sober, adult or child, without some way to climb back up, you could easily drown. What if a child fell off that pier. Just something to think about.

The truth is, I agree with you, but if I could imagine someone saying "They had a ladder into the water right there, so it suggested that it was OK to get into the water, at the very least that was the implication of a ladder going in to the water, so it is their fault that he drowned."

Now the flip side of that is this. Any healthy adult person, even if in a suit and tie, ought to be able to hang on to the side of the pier without a ladder. I guess if it was dark and you were disoriented and you couldn't swim you might not be able to, but if it is dark and you are disoriented and you can't swim you really shouldn't walk out on piers to take a leak - I'm not sure that a ladder would be any more help. I can't see that it would be any easier to find a ladder in the dark than it would be to just hold on to the side of the pier.

OK. This is a tradgedy, and I don't want to act like it isn't. But when this happened wasn't there something to the story about how the wife had left the GF and gotten a room at the Carribean Beach that night herself? Didn't they only find the guy the next day? Wasn't it the case that she wasn't looking for him the night before? Wasn't the cause of death on this ascertained to be that he committed suicide by swimming from the beach while drunk after arguing with his wife? 10 million dollars for the loss of someone you just left? Again, it is a sad story and I don't say these things to rub salt on anyones wounds.

I imagine that it will now be more difficult for anyone to take a moonlight stroll down by the water. Thanks.

sorry double post

I'm still waiting for a four person drunken surrey bike mishap on the Boardwalk.

If a dock is bad, that place must be a death trap! :)
