Flybe won't pay for my damaged bag

We used Flybe for our connection from Belfast to Gatwick for our December trip. On arrival at Gatwick it became apparent that one of our suitcases had gone missing. After 2 hours running around the airport we were told to check back the next morning. At 7.30 am the next day I got a call from VA saying they found one of our bags on the airfield however it had been bust open and had been rained on all night!!

Turns out the bag had fallen off Fly be's luggage trolley and the Samsonite suitcase and it's contents were ruined! I was slighly delayed putting a claim into Fly be as It was Christmas and I had been ill for a week too! I have just recieved a letter from Flybe saying that I should have written to them within 7 days of the suitcase being damaged and they are paying me NO compensation! I am really disgusted!

Has anyone any suggestions?

I totally agree!! I will be writing to them AGAIN when I get home from work today! I also reported it to my insurance company so may forward it to them to see if they can get anywhere! I will not give up easily!
 
That is terrible!! I would kick up a real stink over this!

Where does it say you have to claim within 7 days? That is just silly. Good Luck.
 
Just found this on a consumer website, doesn't sound good for you.

While you may get compensation for delayed, lost or damaged luggage, the amount you get is likely to be very small. This is because airlines work out how much to pay using the weight of your luggage and not the value of it. So, if you're travelling with anything very valuable, check to make sure your travel insurance policy covers it. Also, make sure you claim for any loss or damage before you leave the airport. Luggage claims are always against the airline - even on charter flights.
 
Complain as much as you can, try and get the name of the costumer service manager.
It happened to us 5 years ago with BA - one bag damaged, one bag lost.
We got the lost one back eventually.
BA tried to give us 500 air miles - but as I pointed out to them - anyone can collect air miles, eventually after writing and complaining and causing a major fuss - calling them everyday we got two free world traveller tickets and went to yes that's right .......... FLORIDA! go for it!

ARTICLE 16 - TIME LIMITATION ON CLAIMS AND ACTIONS

16.1 Notice of claims
16.1.1 Acceptance of Baggage by the bearer of the Baggage Check without complaint at the time of delivery is sufficient evidence that the Baggage has been delivered in good condition and in accordance with the contract of carriage, unless you prove otherwise. If you wish to file a claim or an action regarding Damage to Checked Baggage, you must notify us as soon as you discover the Damage, and at the latest, within seven (7) Days of receipt of the Baggage. If you wish to file a claim or an action regarding delay of Checked Baggage, you must notify us within twenty-one (21) Days from the date the Baggage has been placed at your disposal. Every such notification must be made in writing.


But surely by reporting to the handling agents you have complied with this as the baggae was also delayed not just damaged?

Thanks Claire - it's a complete joke! I could not have written to them within 7 days of receipt of the bag as I was in Orlando! I did notify them by phone 3 times though! I also provided them with receipts for most items in the suitcase! I can't believe they now charge £6 per checked bag - they should also advertise that it will be a bonus if you get the bag at your destination!

I am NOT going to let it go, I will fight them all the way - even if I have to seek legal advice!

I think a majority of tgravel companies either refuse or offer something silly. I have a feeling many people accept it and move on, which is wrong. They know they can do more, but do not want to pay. For those who accepted it and said nuts to it have lost out. Go for it. Fight them for all damages occured.
 
Just spoke with my holiday insurance who i was initally going to claim from and explained the situation. They said the way I have been treated is awful and to get he claim into them ASAP! We shall see how awful they think I have been treated when they offer me a settlement :rotfl: :rotfl:
 
I was going to say get a claim into your travel insurance company. We had a case broken open one year and the insurance company paid out without any problems as long as you have the paperwork to back up the damage ( which you obviously have) you will have nothing to worry about and your insurance company can counter claim against the airline. without you having the bother.
