Ebay transaction...tell me what you think

I bought two items from one seller on 03/11/10, and paid for them immediately. The items were supposedly mailed on 03/13/10. By 03/19, I hadn't received them yet, and emailed the seller. He asked me to give it a little extra time.

By 03/24/10, still nothing. I emailed him and suggested the items were perhaps lost in the mail. He agreed, and said he was mailing another set via priority mail on 03/26/10. He refused to supply me with any sort of tracking information.

As of last night, 3/31, still nothing.

The seller has a good rating...99.7% positive.

Opinions? I think I've given him more than ample time, but two shipments never made it to my home. I'm thinking I should file a claim with Ebay, especially since I've made a few ebay purchases AFTER this transaction, and all merchandise arrived at my home without a problem.
 
I'd give another day or two for the second shipment to arrive. The 26th was a Friday, so the item may not have actually hit USPS until Monday.
 
I would probably contact EBay at this point. You are well past the standard 2 week delivery time. If it was going to be longer than that the seller should have made that known in the listing.

Plus, something is squirrelly. If he truly mailed on the 13th like he said, why would he give you some line about mailing another set. He should have given you a tracking number, at least with the 2nd shipment, given the issues w/ the first. And if he didn't get tracking w/ the second...well that is just stupid, IMO.

He has a decent rating, but with how many transactions. Someone could have 100%, but if they only have had a few transactions, it doesn't mean as much, KWIM?

As an ebay seller, I have occasionally sent out replacements when a customer told me that an item didn't arrive. I think that it is unreasonable to hold a seller to a standard delivery timeframe when this happens. Clearly, a seller cannot turn back the pages of time to get the replacement there any quicker.
 
You should request your money back from paypal right away. If they shipped it they will have a number to put into paypal to prove that they sent it. If they dont have that number you will get your money back in about a week. Remember that sellers can not leave neg feedback anymore, so you have the upper hand. I am a seller for over 10 years now. I have noticed they have taken away any sellers benefits to make sure people can fell good about buying on ebay. :banana:

The first shipment may not have been sent with tracking. It may have just gone first class. This is especially true if it was a low dollar item. Since the second was sent, well, second, the seller may not have sent it through paypal. Many sellers aren't even savvy enough to know that that can be done.
 
If you leave it too long you can't claim - I found that out to my cost. Item never arrived, contacted seller who asked for more time, then more time. I left it and tried a few days later - no response - and too late to claim through ebay or paypal. My fault as I should have claimed before deadlines but now no item and nothing that I can do!! Did leave very negative feedback but barely dents overall reputation.

Since it's been three weeks, I'll go ahead and make a claim.

I do believe the seller was playing a bit of a game with me by asking me to wait and failing to provide tracking info. I do believe he may not have even had the items listed on hand, and perhaps he, too, was waiting on them. Either way, I'm done with this transaction and poor feedback will follow.
