Ebay question

Ok, back in October I ordered something off ebay. I paid for it right then, paypal. Seller emailed me on 10/31, said it was going out that day.Yay, I thought! I needed it soon. I waited and waited and waited and waited and never got it. I emailed her and she gave me the tracking number but I could not find out anything except that they were notified it would ship 10/31.

So I tell her today and she checks on it and said all she can find out is that it was anticipated it would deliver on 11/3, but all we can do is wait now.
She said if I do not recieve it in the next week or two, she would include this item "free" (quotes mine--it is not free if I paid for it, is it??) with my next buy it now order.

Ok, what to do? I did NOT get this item. I am not a scam artist, as she can see from my feedback, which is perfect. She does say that she is not responsible for lost or stolen packages. So do I just chalk this up as a loss? Not leave her any feedback? Next time I will get the insurance but I have been getting ins right and left all these years and never. needed. it. until. now. Ha ha on me!
 
What I have done in situations like this is to open a dispute on Paypal. They will research the problem and may light a fire under Seller. If you are talking to Seller and trying to work it out, you can let her know you're going to open the dispute and that you'll close it once you resolve the issue one way or the other. After (i think it's) 45 days you can't open a dispute, so don't wait too long.
 
I'm pretty sure the seller is obligated to provide you the item if she can't prove its delivery, whether or not you bought insurance or delivery confirmation or whatever. The burden of proof is on the seller, and if she can't provide an explanation for what happened to it, she has to either get you another item or refund your money.

I think there is something written in ebay about this, where I'm not sure. But I had this problem once before and found that out. I did eventually get my money refunded once I filed a complaint in paypal.

A little more info, how did she send the package? (post office, ups, fedex?)

And when you track the item what exactly does it tell you, word for word?
