Ebay question - should I do anything?

I wasn't sure where to post this but it seems the Ebay experts are on this board so here goes....

I won an ebay auction for a Mark McGwire Bobblehead for my son's birthday. We are big Cardinal fans and he has been wanting a bobblehead of one of the players and said McGwire would be his dream. The hunt begins!

I got a great deal on ebay for a McGwire bobblehead. Today is ds's birthday and he was very excited to get it until we realized it isn't a bobblehead! It looks like a bobblehead in the pic, but it is actually a figure. The auction clearly states Bobblehead (I thought I had made a mistake), but the box doesn't say anything about 'bobbling'.

Should I contact the seller? I don't know if she will want it back - we have removed it from the package. It doesn't have any meaning for my ds - he wants the BOBBLE part. The item was cheap but shipping was high.

I appreciate anyone's thoughts! (I am not looking for a full refund of my $$, just wondering if I should notify the seller.)

Definitely contact seller. It sure makes it seem like it is a "bobblehead" in the description and it is not! You deserve a full refund. Maybe they don't realize that the figure does NOT "bobble" because just by looking at the picture who'd think it bobbles. But anyhow, they offered you the funny bobblehead and you deserve that or a refund/return item.
 
The seller called it a bobblehead in their title and information however nowhere on the box shown does it say bobblehead (which isnt your responsibility to look that closely in my opinion)

I would email the seller and just mention that they must have made a mistake in their listing since it is not a bobblehead and your son really isnt interested in it and you were wondering what they would be willing to do?

$8 to ship this seems high for sure
 

well if it is the item in the auction, it sure looks like a bobblehead. We bought a bobblehead recently and I wondered why it wouldn't bob. My DD found a piece of styrofoam up in the neck that kept it perfectly still. Is there space there?
 
I have seen those "Headliner" figures before and they are not really bobbleheads, just figures with big ol' heads!!! It was definitely the seller's mistake to call it a bobblehead. Since it is up to them to list the item accurately, I would contact them about getting a refund.

And yes, $8 shipping was a rip-off! :scared:
 
I also agree that you should contact them. Sometimes sellers are really nice. I bought a camcorder once (cheap) and it wouldn't charge. I emailed the seller and was nice about it, just said that it seems it needs either a new battery or a new charger, and she gave me a full refund, including shipping nad told me to keep it! Great seller. Maybe you'll be as lucky. I know t his is not the norm, but it won't hurt to contact the seller nicely and see how they reccommend reconciling this problem.
 
In the seller payment instructions, it says "All items guaranteed", so I would think he wouldn't have a problem with giving you a refund. You should definitely ask him for one.

I sent the following note to the buyer...

Hello!
I am the winner of the auction listed above, and gave it to my son for his birthday yesterday. Upon opening the package, we discovered that this is not a Bobblehead. There must have been a mistake in the listing and my son is not interested in a figure of Mark McGwire - he wants the Bobble part.
How would you like to handle this? As I stated, we have completely removed the figure from the box, but I still have all of the boxing.

I am hopeful we can resolve this as I still need to find a Cardinals Bobblehead for my ds! :) I still have the box it was shipped in - it says $5.71 - just an fyi.

pyrxtc, thanks for the tip but we checked everywhere on the figure. We did discover that he has a removeable helmet though. ;) Luckily the box says it is supposed to come off! At first, I thought ds had broken it!
