Ebay ??? from Buyers point

I won an auction on 9/28/04. I paid via money order sent priority mail and seller received 10/1/04. The seller sent the item out on 10/2/04 via UPS. UPS to deliver on 10/12/04 but problem with address. Sent the seller many emails to confirm the address item was sent. Seller finally responds asking me to call UPS to give correct info but by that time UPS delivers the item to wrong address. The seller had the wrong zipcode on the delivery address so my item was delivered to another party. I have sent seller another email advising how is this going to be fixed. I have paid $27.99 for shipping with insurance for a $90 item and on the UPS site it says shipping only $10.50 with insurance FREE.

The item happens to be a clarinet for my daughter who is taking lessons via school and I really need it.

I do not know what to do or how to handle this seller. Seller leaves buyer negative feedback if the buyer leaves negative feedback. I think I should have positive feedback because I got the payment out timely.

What should I do???
 
If you truly got your payment out quickly (which I believe you said you did) and you truly got the CORRECT address to the seller, then there is no reason for her to give you neg. FB.... however, that doesn't mean that she won't. At this point you (and the seller) need to deal with UPS to get this straightened out. They should cover the cost of the item I believe. We had that happen one Christmas.... I ordered some stuff for the kids and waited and waited and waited!! When I called the company they confirmed shipping on a certain date... when I contacted UPS they confirmed delivery on a certain date... but the package was nowhere to be found.... eventually we got smart and double checked what address it was sent to.... it was delivered to another town. UPS covered the cost.

WHat baffled me was two things... number one... why didn't UPS try to go and retrieve the package from where they delivered it? and number two.... why didn't the person who received it report it? That is just plain dishonest. Hope their kids enjoyed the $90+ worth of toys that were in the package!! (BTW, my DH works for UPS, so I rarely say anything negative about them, but this is a true story.)

Sorry I cannot be more help, but you don't deserve a neg. FB, but that doesn't mean the seller will agree with me. And perhaps the seller doesn't deserve a neg. FB either... we all make mistakes. As long as somehow this is rectified and you either get your $$ back or your clarinet, then I wouldn't necessarily neg. the seller........P

edited to add... it does appear that the seller did "pad" the shipping charges by quite a bit, but nothing unforgiveable (IMO). But as far as insurance goes... UPS automatically insures all packages for up to $100... so your package was insured for free. Not sure how much of that $27.99 was supposed to be for "insurance".
 
as far as the shipping fee goes, maybe the seller had to purchase a box or boxes from the UPS shipping store to be able to ship your item. Also when I personally shipped out a large item from there, I discovered they charged quite a big "service" fee to ship from there. I had to buy 2 boxes (came to $12, $6 each) & tape them together when I shipped off my 5 foot tall goofy that I sold on ebay a few months ago, but I also stated in my auction that the shipping & handling fees would include the price of the boxes as well as whatever the UPS shipping store charged for delivery. So, maybe the seller wasnt necessarily "padding" the shipping fee + I think the seller also deserves to be able to charge "handling" fees as well. Insurance is usually free for up to $100 when shipping with UPS, Fedex, DHL. the ebay seller may have mentioned that it included insurance just so you know that you would not have to request insurance & pay something additional for it.
 
If the seller put the wrong ZIP on the package then she should either give you a full refund or send you another clarinet.

If the shipping was listed and you agreed to pay it then you cannot complain about it....it was your choice to bid.

As for the buyer leaving a Neg....did they tell you or is it in their auction they will leave Negs if they are giving a Neg? You have 90 days to leave feedback so I wouldn't do anything yet. Try to work with the seller and let them know this is totally unacceptable. You might try contacting UPS yourself since the seller isn't helping.
This is another good reason people like PayPal......you possibly could have gotten your money back since the item was not shipped to you.
