Ebay experts: Am I SOL?

I'm somewhat new to ebay purchases.

I decided to do a buy it now auction for TEVA sandals. They were advertised as TEVA and brand new.

I get the package today. Nowhere on the shoe does it have TEVA. It says "Basswood". Am I correct in thinking this is not a TEVA shoe?

Also, the right shoe's backstrap thing is broken.

The auction states all sales final unless they made a mistake. So, do you think I have a right to a refund (since this is not the shoe advertised and it's broken)? I just sent the seller an email.

Yes, I do think you have a right to a refund. How did you pay? If you paid by Paypal, you can do a chargeback if the seller refuses to refund.
 
Thanks! I did pay via Paypal. I'm going to wait a couple days to see what the seller says.
