DVC Sellers - No more $200 Transfer fee

On Thursday, July 21, 2005 we recieved a fax from Disney which states:

Effective immediately, for all future contracts, DVD will not be charging the $200.00 administration fee.

I was under the assumption that the transfer fee had always been there.

Not that I 'm thinking of selling, but it is a boon for owners to not have to pay it.

I'd ask for a refund if I paid it. The way I read the statues, it's limited to $100 by law.

I guess you could file suit. Why don't you call member services/accounting first and see if there is some Disney magic that can be done before calling in the laywers?

I believe we need a cause of action to file a class action suit. DVC is free to reverse fees effective on a certain date, just like Disney and retailers run a special effective a certain date, and if you miss it, you miss it.

However, I think the important thing is what has been pointed out by Dean and others. WHY are they cancelling the fee?

Also, to file a suit, you also would need to show they collected and refused to give it back. So if you don't request it, you can't show they refused to pay it back.

Trust me when I tell you, the only people who ever make money in a class action, are the lawyers. Were I licensed in FLA, I would love to file this suit.

For those asking, normally the seller would pay the $200 transfer fee. However, it is sometimes written in the contracts that the buyer has to pay that fee.

I guess the nice folks I'm buying my contract from are going to be happy that they get to save $200... now if only I could save $200 more!

Here is a response I sent to a PM that some might find helpful.


FL statute 718 FL statue 721 718 deals with condo's and the way I read the chapter, it would also include timeshares (read definition of condo) and specifically states $100 transfer fee. 721 which is specific to timeshares does not address this issue at all. BTW, 719 (applies to cooperatives) contains the same language of $100 transfer fee.

When a timeshare plan is subject to both the provisions of this chapter and the provisions of chapter 718 or chapter 719, the plan shall meet the requirements of both chapters unless exempted as provided in this section.

I'd recommend you ask for your entire amount back explaining that they abolished the fee and they should refund it. If that doesn't work, then you could go this route and ask for half back.
