DVC renting: how strict is DVC on frequent sells

I know they have some sort of policy regarding renting out your timeshare, but not sure how strict they are. Anybody know if there is a "limit"? We're thinking of renting a portion of our points our regulary to help cover dues, NOT rent out thousands of points like I see some people doing over on the rental boards.

DVC hasn't come out with a hard stance on where to draw the line. The indirect date we've gotten is that somewhere around 20 reservations a year not in your name MAY be the cutoff. You should likely contact DVC to get something directly from them to guide you.
 
Since most renters only want around 50-60 points to stay in a studio for 5 nights, you can hit that point pretty easily if you have a bunch of points to rent.
 
20reservations x 50points=1000points. Are there a significant number of people that have over 1000points???

That is certainly not my position. I have 220point, and would like to rent around 50-60 of them to help cover my dues. I just got $15/pt for a reservation I listed on ebay, and if I can rent a few points and still have enough for my family, I'm going for it.

Given the scenario you outlined, you're not likely to have much of a problem unless Disney radically changes their stance on renting.

Right NOW, it seems their policy is to weed out habitual commercial renters....those renting large numbers of points (in total), and renting on a regular, frequent (multiple times per year) basis. In other words, Disney does not want to have to compete with you, as a commercial venture, for guests. Renting 50 or 60 points per year isn't likely to raise any red flags for them.

I have wondered about this for awhile. Is this the start of Disney cracking down on renting progessive in the coming years. They are limiting a high number of rentals in one year at the point. In coming years could they look at someone that rents year in and out has commercial renting. From their perspective why require a minimal number of points to be purchased if you never use them. Could they want a single entity to use a specific number of points by banking and borrowing to attain a certain level of profitablity for themselves.

It's my opinion that the above statement is misleading and a scare tactic. It suggests that Disney, at it's leisure, could simply mass-mail cease-and-desist letters to anyone and everyone suspected of renting.

In reality, Disney Vacation Development is contractually obligated to use reasonable discretion in any anti-commercial enforcement. Consider also that members are contractually allowed to rent out their reservations and then come to your own conclusion.

Yes, and it's my opinion that rinkwide twists people's words. The point is that it is at DISNEY'S reasonable discretion, not someone else's or some body of laws or regulations. Establishing a pattern of renting for commercial purposes that satisfies a reasonability test that would pass legal muster if litigated is not quite as difficult as some would have you believe, and the number of transactions in a given year may or may not be relevant in a particular circumstance. As I have said before, an absolute defense to a charge of acting for commercial purposes is to rent at an unambiguous loss (e.g., rent at a rate that just covers annual maintenance fees and only rent your own points and there is no question that you are renting at a loss).
