DVC Owner/Renter relationships - references:

I know there was discussion about this at some point.

Some had suggested having a "DVC Owner/Renter" hall of fame of sorts to help owners and potential renters of points with the decision of whether or not to rent points to/from an individual (lowering the risk factor by providing a source of references).

Did anything come of this? Is anyone interested in maintaining a thread where people can at least post good/bad experiences with renting from/to certain people here on the dis??

I could start by saying that I had a good experience renting points this past Feb. from Cindy72. The transaction went well, and reservation was there and waiting for us as promised.
 
I don't think anyone who has rented from the Dis boards rental/trade site - has had a problem - if they did - I am sure that they would have posted here and let everyone know not to rent from that person.

I haven't heard of any problems - has anyone else?

Oh I recommend this site alot - and so far no one has send an email complaining about being taken.
 
There is currently one complaint on the rent/trade board under a title about reservation points for rent. This has been the only complaint I have seen since I have been visiting the Dis.

I can speak personally to a rental from hell. I reserved 120 points for BCV in Nov 03 back on Feb 20th. About 4-6 weeks after that my wife and I decided to purchase DVC instead so I cancelled my reservation with the other DVC member. It has been months and I still don't have my full $1200 back. I just sent a demand letter to her stating that if I didn't get my money back by 7/25/03 (last friday) that I am going to file in Small Claims Court. She didn't return my money and i have Delivery Confirmation that she received my letter. I've called her and emailed her and all she has it excuses. She basically spent the money and is trying to get another renter to pay her so she can pay me.

On august 1, I am posting her name and user id and the full story with dates and descriptions.

If she is reading this, I hope she is listening. She has my phone number and home address if she wants to resolve this before then.

I find it odd that the other post on the rent/trade board is now gone with no word at all if that person's problem with the DVC owner was resolved or not. :confused: The complaint was simple "removed" and the person's post still offering the points for rent remains. How are we supposed to know if they are safe to buy from? I'll personally have to go on the assumption that they are not. :(
 
The Rent/Trade Board is not a discussion board. It has been provided as a "classified ad" area to facilitate renting from DVC members. If anyone wishes to discuss rental policies and seek advice before renting, please feel free to post that discussion on this board (DVC). If you have a general question about "how to rent", the Rent/Trade board is fine.

Since the DIS is not involved in any transaction on that board, the burden lies on every participant to make sure they understand and agree on all aspects of any rental. This would include payment schedules, payment type, cancellation policy and refund policy.

Most have found it practical to make sure these issues are understood in advance before any money changes hands.

If the renter asked for a contract from the member before sending any money, they would have at least something in writing. If the member had provided a written contract (as required by DVC), some issues could possibly be avoided.

The Rent/Trade FAQ does make some suggestions about the process. Some have heeded that advice and even asked for suggestions on this board. Obviously, some have chosen to ignore all advice provided in search of a "bargain".

The DIS has never received a complaint that someone arrived at a DVC resort and had no reservation after paying someone for same thru the Rent/Trade Board. I did receive a complaint today from someone who sent payment last Wednesday and has not yet gotten a confirmation for a date sometime in the future (this was the first complaint ever received from a renter). Possibly, if the renter had heeded advice given in the FAQ and on this board, the problem wouldn't have occurred.

I have also received one complaint from a member who made a reservation for a renter for a date within 1 week in the future. When they did not receive payment, they failed to cancel the reservation and the "renter" enjoyed their stay- never paying the member. Had the member heeded advice- that never would have occurred. (IMO, no reservation should be made within 30 days without full payment in advance- or the reservation should be cancelled in the very least if payment is not received.)

Both members and renters should have an understanding of what is expected of them. If the member insists on payment before the resrervation is made, make sure you can tolerate a wait until receiving the confirmation- or don't send the payment.

If you are unsure of the cancellation policy of the member (most will insist that the renter "owns" the points and will receive no refund- only assitance changing the name on the existing reservation or assitance in making another reservation with the same points- but not a refund)- don't send any payment until satisfied with the policy.

Disney, the DIS and DVC will not intervene with these transactions. Everything is to be handled directly between the parties involved. If you want references, ask for them in advance. If you want to pay by credit card, demand that privilege. If you expect a written contract, demand receipt before sending any payment.

This board will not provide a forum to embarass or expose any transactions in disagreement. All DVC Rent/Trade transactions are between consenting parties.

Discussion of the issues involved are certainly welcome on this forum.

From the DVC POS (7/95) (emphasis added):

" All leasing or rental agreements relating to the use, occupancy and possession of any Vacation Home must be in writing and must set forth an ackowledgement and consent on the part of the lessee-sublessee-tenant to use, occupy and possess such Vacation Home in conformance and compliance with the provisions of the Condominium Documents and these Condominium Rules and Regulations. In the event an owner fails to secure a written leasing or rental agreement, the Association reserves the right to request the lessee-sublessee-tenant to execute an acknowledgment to use and occupy the rented or leased Vacation Home in comfprmance and compliance with the Condominium Documents and these Condominium Rules and Regulations."
 
Doesn't mean the other person won't honor it.....after all it is only a piece of paper....that is why I am taking her to Small claims court.

One can try to do everything right, but if the other person spent the money, they spent the money

I love this website, DVC and Disney in general. I come to this website everyday for info. I have nothing against the people here. I just ran into a bad situation and am now trying to remedy it.

But I feel that the poster that was letting everyong know about the "BARGAIN" $5 / point may be a hoax. This is the type of information that I look for. I have rented to and from a couple of different people on these boards and I have only great praise for all of them. But I had been thinking about this "deal" and I am ever so thankful that I saw the other posters message about what happened and how all of a sudden the points have increased and someone's wallet is smaller and the suppose seller is richer. I hope that this doesn't get deleted, but I have a feeling it may. I have been on these boards when they first started, I don't even remember how long ago. I remember I received a shirt and mug for a membership donation from Pete.
I look to all of these boards for great advice and thanks to all of these boards, I had 4 16 year old girls crying last Wednesday when we had to leave the Beach Club Villas after 10 days. It was a 16th birthday trip for my daughter and she was able to bring 3 friends. These boards are invaluable for useful information. There may be info that is bad for one person but think of how many thousands it may help.
I don't want to start a debate I just wanted to mention my feelings that I felt the original post did belong on these boards. Maybe it could have been limited to just the info about the possible fraud. I don't have $1000 to throw away to anyone.

The poster has started a thread about his experience and it is still on this Board. If any post is presented as information, the post is/has always been acceptable. If it's presented as an attack, it is not acceptable and will be removed. There is most certainly a difference.

Curious as to your initial agreement with the renter. Did you have an agreement that stated it was refundable, if not I think the default posture would be non refundable if not stated otherwise. The few times I've rented, I always stated that it is non refundable.
 
I rented form someone on the rent boards who woudl never send me my confirmation or return my emails or phone calls after I paid in full. I finally had to threaten before they faxed me a copy of the confirmation. I never eecieved the oriinal as promised. I was a nervous wreck and called MS each wekk to make sure the resiie was still there, but all turned out fine. Didn't make for a realxing experince, though.Thsi owner also did the same thing to another renter at the very same time.
I have since commicated with others having similar experinces.
It taught me a valuable lesson, I woudl never rent agin unless there was a contrcat between the two parties and I will only pay deposit until I receive the confirmation in the mail, then I'll send final payment.
I think a reffreal board woudl be great, although we have since bought into DVC.
In retrocept, there is risks for both parties.
