...If a collection agency sends you a letter on a collection, even if its not your responsibility?

FIL passed away last summer and the nursing home/rehab he was in is still looking for 450.00. Since BIL inherited his condo(and made a nice penny when he sold it), he is supposed to be taking care of any bills that come up. Obviously he isnt because DH just received a notice from a collection agency. I dont want to get bad credit because BIL is being an idiot. Up until now we have had perfect credit.
 
I think it boils down to who is the executor of the estate. That person is responsible for settling all claims against the estate prior to disbursing funds to the heirs. If your DH was responsible for being the executor, then he is responsible. If not, the collection agency is just fishing for payment. Remember, they get a percentage of what they collect. If, for some reason, they report this debt on your DH's credit, you can place a statement on your credit report noting that this was not your responsibility and other creditors will be more understanding.
 
Has the estate been discharged through probate? Strange that there is still a bill out there like this.
