Do DVC owners have no control?

Ok I sent out the following to an email group of DVC'ers and I was told as owners none of this is true does anyone know any thing about this?



Ok I know this does no good but as DVC owners we all belong to our respective OWNERS ASSOCIATION , and as such at the next Association meeting we bring to a vote a minimum pool temp. I know that I've read about some people who say they dont care about the pool temp why increase our dues money but I say I go in winter time I need pool temps to be high , I dont need the air conditioner so if we can agree in summer you get ac and winter I get warm pools lets vote a min temp into the bylaws.

For Jan 1st to Dec 31 2005 our estimatated utilities bill was $1,207,443.00 brings it to $00.2470 each point of dues so if all the utilities combined for the entire resort for one year brings my dues portion to less than a quarter I'll gladly pay to enjoy my swim time in winter



I know Disney is the management co but as owners of the boardwalk and members of the boardwalk association dont we have ANY say ? ( or appropriate DVC resort )

I think because of the years ending dates on our deeds we are leasees not true owners.

I could be wrong but we really only have control of what we wish they would do not what we want then to do.

No, we're really owners. DVC is our management company, and we could fire them. However, if we do, we don't get to exchange between the various DVC resorts, and we probably lose a whole bunch of Disney resort-related benefits, maybe room charging, dining plan, pool hopping, etc.

The whole temperature of the pool issue is a tempest in a teapot, and this from someone who visits exclusively over the winter every year.

You can not bring items to a vote from the floor at the annual meetings, nor do members in attendance actually vote on anything. You may ask a question during the Q&A session. Based on our contracts, basically the DVC board casts votes on behalf of members. If we, as DVC members decide to fire Disney/DVC Mgmt Corp as managers of the DVC program every owner would need to be contacted and a proxy provided. Quite a legal undertaking, and I would think extremely expensive as well. Personally, I think the pool temp thing is not worth that kind of action.

This is a very stupid question / observation: Could it be that the pool temp was not set high enough but the outside aire was colder?

I live in Atlanta and we are affected by the same weather patterns as FLA (for the most part). I know it was bitterly cold here for about a 4 week stretch. Most winters here the temps fluctuate greatly - but for a long stretch it got cold and just did not change!

Could this possibly have been the problem this year?

There are two "Condominium" meetings for each resort every year. One is the Board of Directors Meeting and the other is the Members Meeting. The Board of Directors are all appointed by DVC and no members curently sit on that board. The Members meeting is conducted by member representatives- also appointed by DVC and no members currently sit on that body either (at least none elected by the members- some of the individuals chosen by DVC may actually be members). All voting is made by those bodies and, as Chuck already noted, there is no opportunity for motions from the floor or any vote of the members present or by proxy.

As bicker already stated, there is a provision for the owners to vote to replace DVC as the management company of each resort. The consequences of such a replacement would not please most members, but the provision is available. Any such vote would need to be presented and organized by the memberhsip itself, as I can find no provision where DVC would take any part in such an action.

The Annual Meetings do provide an opportunity for questions and comments from those members in attendance, but that takes place after all votes have been taken and after the conclusion of all "official" business.

Thanks everyone for filling me in on this. I did see the part about replaceing DVC as the management board and I read the consequences , not pretty. I just want to enjoy my vacations

This really gets to the point of DVC being a pre-paid vacation service, rather than a real estate investment. As regular hotel guests don't get to dictate to hotels what color to paint the walls, what maintenance policies to adopt, what kind of training to give staff, etc., neither do DVC members. We've invested in an association where we get to benefit from luxurious Disney resort vacations for a period of years. We haven't purchased the right to tell Disney how to operate its hotels.
