Not Always - I had a former employee who was denied unemployment benefits and I the employer went to the hearing in his defense. He was granted his benefits. We were a wholesale glass Dist. and he was accident prone. Plain and simple, we terminated him because the guy was a hazard to himself and others and I told the appeals officers that.I'm glad to hear your DH appealed right away.
Companies ALWAYS try to get away with not paying Unemployment. DH also won on appeal back when he was laid off.
I have no idea what happened with your DH but I agree appeal. Often employers will cite an "incident" that occurred leading to a termination when there really was no incident or the employee did nothing willful to endanger their job. The folks at unemployment are dealing with very strapped budgets and IMO are looking for reasons to deny benefits. I had a Unemployment representative call me last week over a former employee that basically was not all that smart and despite 5 months of training was not getting it and we let them go. The Unemployment rep kept pushing me for an "Incident" I know how this game is played and would not give them one. Former employee was granted benefits.
