We are taking our DN with us to Disney and I have drafted a consent letter. We will be flying. (if that matters) Should it be notarized or just witnessed?

Notarized for sure. Plus have the parents available by phone/cell around the time you will be crossing the boarder.

When I took my DN 3 years ago, I only had it witnessed, but I would rather have it notarized knowing what I know now. We didn't have many problems, although it was harder to take him back to the country that out of it. She asked him many different questions. I had copies of the custody papers and his mothers marriage certificate as well as letters from both parents (separated, never married). I would notarize it.

You should probably go get it notarized (the lawyer/notary could just write up the letter for you). a few years ago i took my daughter on a trip without dh no one asked me anything when i left with her but when I came back the immigration officer questioned me about him and asked for the letter.

dh went to a lawyers office and had it done ...i didn't have to go with him. i imagine that the parents as well as yourself should go together.

Excellent advice. Our family went on a road trip from Ontario to Wisconsin a couple of weeks ago. We took our son's best friend along, and had the notarized letter from his father authorizing him to travel with us (downloaded from the Canada Border Crossing site).

The border guard on the way into the USA made a BIG deal about the fact that there was nothing specific in the letter authorizing us to see medical treatment if necessary (even though we had copies of his travel insurance info). So be sure to add in that section.....I am surprised that the draft copy on the website doesn't include that when its obviously important.

That's it right there .... get this document and use it. Have a phone number where the parents can be called and you are set. If you are flying out of YHZ then this should be a breeze.

How old is the child?

I don't bother getting my letters witnessed anymore as that just verifies my signature. BTW a commissionaire of oaths signs for free if you really want your signature witnessed.
If the child is old enough to speak for themselves then the border guards will ask them questions if necessary.
The only time I have been asked for a letter is when we are coming back into Canada.
DD12 just came back from the US from a soccer tournament. She went with another parent. She also goes across with me a lot. I'm divorced and remarried and DD12 has a different last name than me.

Did this yesterday as I'm taking DS and DD to DL without DH. The Notary Public had a form letter that DH filled out - needed both kids and my passport information. Cost us $28. Pretty sure I'm not going to be asked as kids are 14/15, but it is more for my peace of mind that I won't have any problems with Customs in LAX.

Here in Ontario I went to service ontario to get my consent for my MIL to take my DD out of the country, They did it for free, I am sure their is a service in NS that does the same thing. I called City Hall and asked them where I should go and they told me.

They make you swear your telling the truth and all that Jazz, have you sign it and stamp it.

Well we leave in less than a week and I have had the letter drafted forever but I need my brother and sister in law to come pick it up and get it signed. Grrr I need to have this stuff done because I am going to go insane. I guess I gotta get my Mom on the case.

With a mere 4 days before we stay at the airport hotel before we catch an early flight and we still don't have a signed letter of consent. I am not sure why her parents don't see the urgency but I am getting worried. We still don't have her clothes packed either. I am a Type A personality and I love to plan and maybe sometimes I have to loosen up What would you do if at the time of departure and still no letter? My niece is 7.

We just returned this past Monday and I took my nephew. Same type of scenario... Departure was quickly approaching and allthough I was calling both of his parents(seperated) on a weekly basis neither had yet bothered to do the paper until just a week before, they also did not see the urgency in having it.

I finally told them that if I did not have the paper the weekend before we departed, they would have to explain to their 8 year old why he wouldn't be spending his 9th bithday at Disney. I also reminded them that this was not a cheap trip and that I was not willing to compromise vacations for 5 other people on their account.

So I ended up getting the papers the weekend before!! Yippie!! Didn't need it on the way there, didn't need it on the way back and a good time was had by all!! It would have been my luck though that I wouldn't have it and they would have asked for it.
