Can just mommy take the kids to Disney?

Hi, i was wondering about travel laws when taking kids on a plane out of state for trips, including going to Disney. Would DH have to sign something or can i just go on vacation with them?
 
Assuming you are married and there is no custody agreement to worry about there should not be a problem. I have traveled out of state with just me and DD and been fine. I THINK you may need something to travel outside the united states, but I am not sure.

If there is a divorce/custody to deal with things are different and it would depend on the stipulations of the divorce decree along with state law in some places.
 
I am divorced and took my kids to Disney last summer with no problems. A couple of summers ago we drove to the Canadian side of Niagara Falls and I did have him write a notarized letter that it was okay for me to take the children out of the country but the border patrol never asked anything about it.
 

Done it many times when my kids were young - dh didn't have as much vacation time as I did. Not even sure who you think would be checking on this type of thing anyway?

i thought when you get to the airport they would ask you where the father is, if he gave his permission to take his kids out of state.. or country... so is it fine to go on a cruise w/o needing anything?

A cruise most likely involves out of country -- different question than out of state. It is strongly recommended to have a notarized letter from the "absent" parent if only 1 is traveling out of the country with the child. Such letter may or may not be requested/looked at, but in the event it is requested having one ready can save a lot of hassle. Passports are suggested for international travel as well, and required if flying.

If simplying flying domestic across state lines, there is little issue. As someone mentioned, there could be stipulations in a custody order that impact it, but in general no U.S. laws. If traveling with a foster child, that may be restricted; check with the agency.

Who is "they"? TSA? They are there to check for harmful objects/substances in your luggage, not your travelling arrangements with the kids who are accompanying you.

The only time this question might arise is at Customs/Immigration for international travel , and would only be an issue for those with divorce/separation custody rulings.
 
You can take anyone's kids on a plane without a note.

If you are leaving the country you can't. I know if we try to cross the Canada-U.S. border without one parent you do need a notarized letter from the other parent or custody papers. Car or plane. So a cruise you may want to check into.

True. In the original post, the OP was just talking about domestic flights.
 
My ex took my son on a cruise with no questions asked (with my permission).

And I've flown with my son countless times, just the two of us. No one cares. We even have different last names and no one has ever asked any questions.

You asked about out of state - not a cruise so no, nobody at the airport will ask you anything about why or whom your traveling with. I have traveled as the solo adult with nieces, nephews, my kids, my kids friends and not once ever has the airline or the TSA asked me a single question.

A cruise is a different story if your traveling out of the country and honestly I would research that with the cruise line for the most accurate up to date information.
 
If your flying domestic, nothing special is needed to bring the kids on the plane. Just make sure you follow your custody order in case there is some window your opening for your ex to start legal issues with.

I've taken dd on a plane out of state without dh. Never crossed my mind to need any kind of permission since there is no custody arrangement to deal with.

You'll want to make sure you have their medical insurance cards with you, and maybe bring a copy of birth certificates (we never needed it, but have occasionally carried it when flying to prove her age before she was 2).

A cruise that's out of country would be different. They would in that case need a passport at the very least (at least I wouldn't take them out of the country without a passport, even if you technically could )

When we took our cruise we were asked if we had documentation of proof of permission from my ex husband before we were allowed to check in. Thankfully I did.

If you leave the country (and a cruise nearly always includes leaving the country), AND you are divorced or not married to the other parent, you may be required to have written permission from the non-custodial parent or other legal documentation that it is okay for them to leave the country with you. Within the US, you don't need anything, especially if you are married.
