No to both questions. The current perk ends December 29, 2012. The new perk begins in January 2013. Here's some quotes from the DVC regarding the announced dates that TOTWL is available for all members. Also note that there isn't sufficient room for members to park at the resort, so you need to take Disney Transportation to get there.

The popularity of a special perk originally slated to end on Aug. 25 has prompted its extension! From now through Dec. 29, 2012, Disney Vacation Club® Members staying at any Disney-owned-and-operated hotel at the Walt Disney World® Resort (whether they booked with vacation points or cash) may enjoy complimentary access to one of the vacation kingdom's most exclusive spaces: the Top of the World Lounge atop Bay Lake Tower at Disney's Contemporary Resort.

A popular member perk is being extended through 2013. *All members staying at Disney Vacation Club resorts using their points can continue to access Bay Lake Tower's Top of the World lounge. *Execs stressed that the resort does not have sufficient parking for non-Bay Lake guests wishing to visit the lounge--Disney transportation must be used to reach the resort. *Due to expected high crowds, the lounge will be available only to Bay Lake Tower guests on July 3 & 4 and December 30 & 31, 2013

Blackout dates are Dec 30 & 31 and July 3 & 4 if not staying at BLT. Resort ownership does not give any benefits.

Ok...while we will be at BLT 12/30 (arrive 12/26) so maybe will go then and then 12/31 (VWL) go to MK park unless I have lost my mind by then
