our neighbors broke into our apartment and stole $8000 worth of stuff. This was 1 month ago, and insurance covered everything minus a $500 deductible. We just found out for certain that it was them yesterday. Is there anything we can do legally to make them pay for this? I think at least they should be responsible for the $500 we had to pay. Any advice would be appreciated.
 
Wouldn't this be a job for the police?
And shouldn't they go to jail rather than just pay you back $500 and keep being your neighbors?

I am so glad you asked! Our DS#1's car was stolen out of the driveway last fall. It didn't get very far since it got impaled on the neighbor's mail box across the street. The police came, and as good fortune would have it, DS had washed it the day before. There was a perfect palm, hand and finger print on the passenger door. They dusted for the print and we really didn't think that it would lead to very much but we were happy that the police made the effort. Lo and behold. They found the perp. He is a teenager under 18. We submitted the cost of the damage to the police. They forwarded it to the prosecutor and when it came time to go to court, we were notified by the prosecutor's office for a victim statement/request. This is what he wrote; Names deleted to protect the guilty.

"Dear Mr. XXX,

Thank you for contacting me in the matter of the State V. James XXXX, XXX, Docket: ####S. My interest at this time is limited to full restitution to myself, and my insurance company, USAA, if that is possible. My out of pocket costs were limited to the $500 deductible on my insurance policy. Enclosed, please find a copy of my insurance policy which reflects my deductible. I trust that the State will pursue the best resolution in this case that will provide restitution to those who sustained financial loss and assist Mr. XXXX in turning his life around. "


We were thrilled to get a check for $500 for the deductible. My neighbor received money for the cost of his mailbox. Contact the police. Make sure they know how much you were out of $$$ and ask that it be forwarded to the court.
 
thanks for the advice. The neighbors are going to be evicted. I will let the police know that we at least want the $500.

That's awesome! I'm happy for your DS. I think that's a good way to go, if you can. We weren't as fortunate when our car was hit and totaled, in our driveway, at 3AM by a drunk driver who had stolen his ex-wife's car while she was on vacation!!!! :scared1:

Since the guy didn't work, we didn't get our deductible back.
