I would like to put a picture of an iPod on my business card and on my website. Is it legal?

Way back in my paralegal days, I seem to remember that it is IF you have the registered trademark symbol on the site or card.
 
I have all kinds of trademark questions!! How does one go about trademarking a name, for instance??

ETA: Sorry, didn't mean to go OT but I thought....if anyone reading this thread just happens to know..... :confused3

Are you an ipod salesman or something? Why would you want an ipod on your business cards.

I am not an attorney, but my first thought is no, you probably can't use someone's trademarked property in your own advertising.

I have a business where I take people's CD's and transfer them to thier iPod. I found a site where it does seem like it is legal. Still checking.

Actually--the actual piece of equipment is not a trademark. To the common person--a little MP3 gadget looks all one and the same until you get to the label.

The symbol is and any ad/marketing material is copyrighting. But merely an image of something you own is not a trademark infringement (as long as any trademarked symbols are smudged out or cannot be seen).

1. Endorsement or Sponsorship: Apple does not support the use of its logos, company names, product names, or images of Apple products by other parties in marketing, promotional or advertising materials as their use may create the perception that Apple endorses or sponsors the product, service or promotion.

I don't know exactly what a court would decide, but I do know Apple (R) is very protective of their copyrights and trademarks, and very litigious.

And just so I'm in compliance with their guidelines: Apple (R) is a is a trademark of Apple Computer, Inc., registered in the U.S. and other countries.
