Another Ebay Question--Rec'd. Wrong Item

My DS won an auction on Ebay for an XM Radio back on Dec. 3rd and paid for within moments of winning. After two weeks, he hadn't received anything so he emailed the seller. He skirted around the issue saying he had been out of town and assumed his wife had sent it. After a few more days and nothing, my DS contacts him again and he insists his wife sent it out right away. He said the post office was extremely slow due to the holidays, etc. and it was taking 3-4 times the normal shipping time. We asked for a tracking number and nothing was offered just more excuses that the post office was delaying delivery.

My DS explained it was a Xmas gift and he needed to receive it by 12/24, of course. This was in an email on 12/18. Still just lots of excuses it was delayed by post office.

Oddly the package shows up on 12/22 and I check the post mark which was 12/18, the date of my DS's last email. So, of course, it never went out. Now the topper--it's the wrong item. He sent DS the "older model" and not the model that was on the auction. He emailed seller and told him was understandably upset after being so patient for almost 3 weeks. The guy offers up no explanation, nothing more than just send it back to me.

The problem, the guy was just rude. We emailed him today giving him the link to the original item and itemizing all the various correspondence, etc. We told him we would return it (he never offered to reimburse us the cost to return it---it was his mistake) and we expected to be reimbursed within 24 hours for the initial purchase cost plus shipping (to offset the return shipping costs). We told him we did not want to give him negative feedback on Ebay or report this assuming we would receive the money back quickly. We told him we'd send it Priority Mail and email him with tracking # so he could trace and we'd know when he got it.

The problem--we get this absolutely horrific, vulgar, nasty, and rude email back. Our emails were all nice and cooperative but clearly explaining he made the error and strung DS along. I am totally PO'd about how nasty and vulgar he was.

I don't want to return his email mainly because I don't want to risk not getting the money refunded. Is there anything else we can do here? We've been cooperative and he's obviously got issues. I don't know enough about Ebay to know if there is someone we can contact or if we should just ignore this jerk.

Suggestions anyone?
 
Do not send him anything yet. You need to file an 'item significantly not as described' dispute through Paypal, they will contact the seller and they will tell you how to proceed. (you actually just need to go to your 'won items page', the option is in the drop down box on the right side of that item, click where it says 'report item as not received' and Ebay will automatically redirect you to the Paypal dispute area)

You will click on 'item significanty different than described' and there will be a box where you explain exactly what has happened so far, keep it to the point and not emotional.

And make sure you save all emails and ONLY correspond with him via the Paypal dispute process.

BTW what kind of rating does the seller have? When I bid on items, especially collectable dolls I have a check list before bidding which includes:


How long the seller has been on ebay: I NEVER ebay with anyone that has an account for less than 6 months. I know a LOT of my friends who have got scammed on collectable dolls because Ebay doesn't moniter when bad sellers just quit using there old names and register under new ones. :sad2:


user feedback rating : Under 98% is an automatic 'skip this item'. And if it is less then 100%, I always check to see why they got a negetive, and if the issue was resolved.

form of payment: I NEVER deal with ppl who only accept checks or MO, they are VERY hard to trace. I only deal with ppl who take Paypal or something similar.

I would definatly contact Ebay and Paypal and file a report. Get your money back, and then post a negative on his Ebay account.
 
I couldn't believe it when I read the original post! Can you provide ebay seller's ID, as this recently happened to me also (rec'd something different than what I won bid for). Still waiting for item I won, after numerous emails back and forth to seller.:mad:
