Well, I told you last week about the situation with the ex. I went to the lawyer on Thursday and he said I have a good case on contempt of the visitataion order. However, in 1995 when we had last gone to court, the judge said before we can come back to court we have to go to Dr. ________ for conflict resolution counseling. My lawyer said, make the appt, and go. He said I do not have to go and sit in the same office with the ex. He said if I go I will have fulfilled my end of the previous court order. Then we will file. The lawyer was in complete agreement with the letter I handed the ex Thursday, when he brought DS home. It stated, he was not to go to the school to pick DS up on Wed., that the standard order states the mid week visitation is Wed. 5:30-8 PM. He is to pick DS up at home. I met with the school principal on my lunch time Thursday. I gave her a copy of the divorce decree and the visitation schedule. It is all there, in black and white! She assured me the ex would not be able to pick DS up.
Friday, I went to pick DS up at school and he informed me his dad had been to the school to return his books. He told DS that he would be there Wed, as usual, to pick him up that nothing had changed! He had been picking DS up at school on Wed. for the last 3 years and nothing was going to change! I called the latch key supervisor and advised her of the situation. They all had copies of the divorce decree and copies of the court visitation schedule and even the police officer for the schools talked to everyone and I was reasurred over and over again that the ex would not leave Wed. with DS.
Well, guess what!? Yesterday was Wed. I debated all day as to whether I should take off early to pick DS up or let the school handle it. I talked it over with a friend at work who is our 9-1-1 coordinator. She and I came to the conclusion that I should stay away from the school, in case the ex did show up, so we would not have a confrontation there. So, when I left work at 4:00 to go pick up DS, I saw the ex's truck in the parking lot. Rather than pull in, I went straight back to work at the PD and asked that an officer stand by while I picked up DS. When I went back to the school the ex's truck was gone and so was my DS!
They had the documentation showing custody and visitation times and yet they permitted the ex to leave with DS.
I have the taped conversation of an employee at the latch key program when she called the police dept, AFTER THE FACT!
As luck would have it, the school superintendant is out until Monday. I have an appt. at 11:00 Monday and am taking the taped conversaton.
I just want this all to be settled. I hate all this conflict!!!!!
