Alligator Attack ruled an Accident

I agree but I'm sure some would think Disney is at fault here.

I genuinely want to know. I don't think any one thinks this could be intentional. So what are the other possible conclusions they could have reached?

If Disney was found at fault, is that not still accidental?

One of the articles I read explained that they had to determine whether the attack was "a predatory event" or "one evoked by human behavior." I wonder if they were considering whether all of the people feeding the gators at Disney or the fact that Disney held the movie on the site of the beach could have "evoked" the event.

Still, lots of accidents, such as car accidents and falls, are "evoked" by human behavior. We still consider them accidents.

There is a lot of legal jargon out there that makes what seems like an open and shut case far more complicated than we might imagine.
 
I'm kinda offended it was announced at all...

...of course it's an accident. Let it rest. Sometimes "say nothing" is best.


...but to answer the question...they didn't put the report out to absolve Disney...they did it just as much to absolve the parents...my take

In this case I imagine it was a matter of ruling out negligence, among other things. Which legally differs from accident.

I read the whole state report...it's not about assigning negligence.

Florida doesn't "do that"...

New York does that...California does that...

Florida not so much.

It's a sad story...and they do a decent job of tactfully highlight all the mistakes...but they don't give the smoking gun of negligence.

The easiest solution...it's now clear...was for the lifeguard/rec coordinator to clear the beach at 8:15.

I'm 99% sure that's who was "told" of the animal by the first employee that was notified by the second witness account.

It's a shame...just unfortunate oversight.

And Disney response has been appropriate...they have spoiled and/or hungry gators...the wall constuction was needed.

Just so.

Having done a little work with my state's CPS, that was exactly what this was about. The report will be forwarded to the local prosecutor and Florida version of CPS, both of whom will now take a pass.

And I'll echo what others have implied, "accident" doesn't mean someone is not going to pay.
